AN ORDINANCE ESTABLISIHING THE NUMBER AND RATES OF COMPENSATION FOR ALL
POSITIONS IN DEPARTMENTS, OFFICES AND OTHER AGENCIES OF THE COUNTY OF
HAWAII UNDER THE LEGISLATIVE CONTROL OF THE COUNTY COUNCIL, DESIGNATING
PAYROLL PERIODS, PAY DAYS, PRESCRIBING CERTAIN REQUIREMENTS WITH RESPECT
TO OVERTIME, PERQUISITES AND OFFICIAL FIDELITY BONDS, AND REPEALING
ORDINANCE 627, AND AI,L AMENDMENTS THERETO; SAID ORDINANCE TO BE KNOWN
AS THE SALARY ORDINANCE OF 1975.
BE IT ORDAINED BY THE'. COUNTY COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Declaration of policy. It is the purpose of this
ordinance to fix and establish the number and rates of compensation
for all positions in departments and offices of the County of Hawaii
under the legislative control of the County Council pursuant to the
provisions of Sectior.~ 3-14, County Charter, and chapters 76 and 77 of
the Hawaii Revised Statutes. This ordinance also covers other matters
relating to compensation of county employees. The term "Employees" as
used in this ordinance shall include all officers.
SECTION 2. Payx•oll periods; pay days; fractional computation. All
salaries and wages sYiall be earned and payable in semi-monthly payroll
periods, from the first (1st) to the fifteenth (15th) of each month
and from the sixteenth (16th) to the end of each month;
The fifteenth (15th) day and last day of each month shall be the
pay days for all employees;
In the case whex•e the required service has been rendered during a
full payroll period, one-half (1/2) of the monthly rate shall be paid;
The Director of Finance shall he authorized to approve payroll
claims covering compensation for fractional parts of a month computed
otherwise than in accordance with the foregoing requirements, in cases
where compl iance with such requirements would result in har dship or
unfairness to the empl oyees involv ed.
SECTION 3. Rate of compensat ion. (A) The monthly rat es of compen-
sation for positions c overed by th e position classification plan shall
be based on the salary schedule an d wage board salary sched ule as
determined and fixed i n accordance with collect ive bargaini ng Agreements
and all app licable law s thereto. (B) Employees occupying p ositions not
subject to the compens ation schedu le set forth in subparagr aph (A) here-
inabove sha ll be paid at rates of compensation as fixed and established
by applicab le provisio ns of the Ha waii Revised Statutes and any act
amendatory thereto, or any resolut ion in pursua nce thereof by the County
Council in accordance with the fol lowing schedu le:

Declaration of Policy: The Mayor shall review and compensate officers
and exempt employees at an appropriate step within a salary range on the
same basis as employees of bargaining units provided, however, review
and compensation shall be based on assuring a sensible relationship and
attracting and retaining competent persons for county service, establish-
ing and maintaining a ]nigh level of efficiency of such persons and
adequately compensate them for the work they do.

SECTION 4. Employment governed by budget and appropriation.
Employees to fill the positions enumerated herein are to be employed as
needed and as specifie:9 in the respective applicable department budgets
approved for the year, or in ordinances or resolutions supplemental there-
to, to the extent that funds are available and appropriated by the County
Council as provided by law.
SECTION 5. Emergency Employment. When an emergency exists in the
opinion of the Mayor, and additional labor or service, not provided for
by this ordinance, is needed by the county to care for such emergency, the
Mayor is authorized to appoint to a position or employment with the county
any such person or per:aons as he deems necessary at rates within the ranges
of compensation prescribed herein, which are comparable to the rates
established hereunder :in view of the labor or service to be performed,
to care for such emergency; provided, however, that no person shall be
so appointed unless at the time of appointment of such persons there
shall be available legally expendable funds sufficient for his compensa-
tion. In the event the Mayor appoints any person or persons to positions
or employment under this section he shall report the same to the County
Council at its next regular meeting.
SECTION 6. Perquisites. That, pursuant to provisions of Section
77-16, Hawaii Revised Statutes, each department head shall determine,
subject to the approval of the Mayor and under such directives as he
may issue, the reasonable value of allowance rendered to employees in
the form of quarters, ]peat, light, household equipment, and maid service,
laundry service or oth~>_r perquisites at the expense of the county but not
for the convenience or benefit of the county and cause the reasonable
value of such allowance=_s to be deducted from the compensation of such
employees. The department shall notify the employees concerned of its
findings and transmit the same to the Director of Personnel Services and
the Director of Finance=_.

SECTION 7, Official Fidelity Bonds. Pursuant to the provisions of
Sections 62-7 to 62-9, Hawaii Revised Statutes, and any act amendatory
thereto, or any provision passed in pursuance thereto by the County
Council, official fide:Lity bonds, filed and approved in the form and
manner set forth in Section 46-26 and 46-28, Hawaii Revised Statutes,
shall be required of the persons appointed to or occupying certain
positions enumerated in the above sections; said bonds shall be in the
custody of the Director of Finance, excepting the bond of the Treasurer
which shall be in the custody of the P4ayor.
SECTION 8. That +~11 positions in departments and offices of the
County of Hawaii under the legislative control of the County Council of
the County of Hawaii b.=_ and the same are hereby fixed and established
as follows:

SECTION 9. The positions and rates of compensation adopted in the
1975 budget of the County of Hawaii are hereby ratified and confirmed
as of July 1, 1975; anal that any creation, reallocation of positions,
salary range reassignment or other changes of pay subsequent to the
adoption of said budget, shall take effect as authorized on the date of
such creation, reallocation, salary range reassignment or change of pay
or a date otherwise prescribed, subject to the certification of avail-
ability of funds by the Director of Finance.
SECTION 10. Ordinance 627 and any resolutions amendatory thereto
are hereby repealed.
SECTION 11. The repeal of the ordinance, enumerated in Section 10
above, shall not affect any act done, ratified or confirmed, or any right
accruing and accrued or established, or any action, suit or proceedings
had or commenced in arty several cause prior to said repeal, but all rights
and liability under said ordinance hereinabove repealed shall continue and

may be enforced in the same manner and with the same force as if said repeal
had not been made.
SECTION 12. Sever;3bility. If any section, or any part or clause of
any section, of this ordinance be decided by the Courts to be unconstitu-
tional or invalid, the :;ame shall not affect the validity thereof which
can be given effect without that so decided to be unconstitutional or
invalid.
SECTION 13. This ordinance shall be known as the Salary Ordinance of
1975 and shall take effect as of July 1, 1975.
