AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP CHAPTER 8
(ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING
THE DISTRICT CLASSIFICATION FROM DOUBLE FAMILY RESIDENTIAL (RD-3.75) TO
GENERAL COMMERCIAL (CG-7.5) AT WAIAKEA, SOUTH HILO, HAWAII, COVERED BY
TAX MAP KEY 2-2-54:42.
BE IT ORDAINED BY THE CGUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article 2,
Hawaii County Code, as amended, is hereby further amended by adding
thereto the following subsection:
"7,29 ( kk ), The district classification of the following
area situated at WAIAKEA, SOUTH HILO, HAWAII, shall be GENERAL
COMMERCIAL (CG-7.5)
Beginning at a point, at the Southeast corner of this parcel of land
and on the West sides of a 20-foot road, (Manini Street), the coordi-
nates of said point of beginning referred to Government Survey
Triangulation Station "Halai" being 1897.23 feet South and 7617.45
feet East, and running by azimuths measured clockwise from true
South:
1. 77° 56' 65.98 feet to a pipe;
2. 156° 35' 20.26 feet to a pipe;
3. 168° 06' 39.55 feet to a pipe;
4. 257° 45' _'.7.42 feet to a pipe;
5. 168° 34' 1.7.32 feet to a pipe on the South side of
Kekuanaoa Street;
Thence along the South side of Kekuanaoa
Street, along a curve to the right, having
a radius of 4970.00 feet, the direct chord
azimuth and distance being:
6. 265° 37' 12" ;53.35 feet to a pipe;
7. 348° 34' 72.40 feet along the West side of a 20-foot road
(Manini Street) to the point of beginning
and containing an area of 4,641 square feet.
"All as outlined in red on the map attached hereto, marked
Exhibit 'A' and by s~eference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect fortii~.~ith
upon the conditions that: (A) construction of the proposed facility
commence within one year of the date of approval of the change of zone
request and be completed within two (2) years thereafter; (B) that all
applicable rules and regulations, including the "Plan Approval" process,
be complied with; (C) that all drainage concerns be resolved with the
Chief Engineer and the necessary improvements placed by the applicant
prior to occupancy of the facility; and (D) that access to the property
shall be allowed only from Kekuanaoa Street.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such :invalidity shall not affect the other parts of
this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.

We have additional comments as follows:
;This property lies in low lying terrain where drainage flowage from the
developed areas of the Hilo Shopping Center complex and its surrounding
area, and also the flowage thru the Kawili Stream from the area mauka of
Kinoole Street in the vicinity of Waiakea School accumulates. Construc-
tion plans for the proposed Kanoelehua Channel has been prepared but the
water quality standard regazding disposal of storm water into the Waiakea
Ponds and other consideration such as land requirements led to recansidera--
~~ tion of the improvements. Instead alternative plan of Panaewa Forest Storm
water disposal pond project is now being implemented, as you are aware.
Improvement to Kekuanaoa Street with curb and sidewalk has also been
planned but implementation is not imminent because of high construction
and land cost estimates.
Because of the existing drainage problem on the subject parcel of land,
consideration of the application shall require for approval the submittal
of the applicants development plans with acceptable provisions for drainage
disposal to take care of the present ponding situation and the on-site
development so that the present run-off condition will not be aggravated.

to be utilized as a retail tire outlet, with parking area, is attached,
These plans are submitted at this time to indicate the proposed land
utilization and the willingness of the applicant to build in a manner
that would be most compatable to the surroundings and traffic conditions.

This Bill. amends Chapter 3 (Regulations Promoting the General
Welfare), Hawaii County Code, by the addition of a new article
(Obnoxious Substances),
