BE IT ORDAIN D BY THE CGUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section. 7.29 of Chapter 8 (Zoning Code), Article 2, Hawaii Coun t Code, as amended, is hereby further amended by adding thereto the followin subsection.: "7G29(nn). The district classification of the following area situated at Waiakea. Homesteads 2nd Series, Waiakea, South Hilo, Hawaii, shall b~ Single Family Residential (RS-15): Beginni g at the Southwest corner of this parcel of land, being also the Sou beast cornea of Lot C-1 and on the North side of Kawailani Street, the coordinates of said point of beginning referred to Governm nt Survey `T'riangulation Station "TTALAI" being 12,461.38 feet South a d 1,870.93 feet West, and thence running by azimuths measured clockwi e from true South: 1. 175p 40' 502.00 feet along Lot C-l; 2. 265 40' 121.00 feet along the remainder of Lot C-2; 3. 355 40' 502.00 feet along Lot D; 4. 85 40' 121.00 feet along the North side of iCawaila:~i Street to the point of beginning and containing an area of 1.3944 Acres. 'A~1 as outlined in red on the map attached hereto, marked Exhibit 'A° and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the con itions that: (A) the applicant, John Carvalho, submit a sub- division pla and secure tentative approval within one (1) year of the effective da e of appro~~al of the subject re.Iuest. The applicant shall also be resp nsible for securing final subdivision approval; (B) construc- tion of anot er single family dwelling commence within three (3) years of receipt of final subdivision approval and be completed within one (1) year thereafter; (C) a ten (]LO) foot strip along Kawailani Street be delineated and set aside for future road widening; and (D) a payment of fee for park and recreational purposes for the area shall be required at the time of subdivision lapproval, using the standards and guidelines of the Park Dedication Orrdinance. Should any of the foregoing conditions not be met, rezoning of the property to its original zoning designation may be initiated. SECTIONS. In the event that any portion of this ordinance is declared invalid, sucl'n invalidity shall not affect the other parts of this ordinance. SECTION'4. This ordinance shall take effect upon its approval. The area :in question is located along the north side of Kawailani Street, approximately 250 feet mauka of the Kawailani Place Subdivision and also slightly over 3/4 mile mauka of the Komohana Street-Kawailani Street intersection, Waiakea Homesteads, South Hilo (TMK: 2-4-03:por. 48). The requested area is a portion of a 5.1-acre parcel. In request of the change of zone, the applicant intends to create a 2-lot subdivision. One (1) of the lots will be 15,000 square feet in size<ind the other lot will consist of the remaining requested. RS-15 zoned area. Approximately 3.5 acres of the property will be retained within the Agriculture 3-acre (A-3a) zoned district. In support of the request, the applicant has stated the following: "This is a request to create a 15,000 square foot lot in knack of our home at 1176 Kawailani Street in Hilo. We plan to give this lot to our son, Jerry Wayne Carvalho, to build thereon a small home for himself and family consisting of Hrife and 2 minor children. Without our assistance in thi:~ respect, he cannot finance the purchase of a home." The General Plan land use pattern allocation guide map desig- nates the area for Low Density Urban Development. Such a designation may allow single family residential uses at a maximum density of four (4) units per acre. The land is of the Olaa soil series which consists of well- drained extremely stony silty clay loam that formed in volcanic ash. Thfa surface layer is about 16 inches thick and the subsoil is about 9 inches. It is underlain by Aa lava. This soil dehydratE:s irreversibly into gravel-size aggregates. It has a medium ac;id surface layer and a slightly acid subsoil. In places, the surface layer is non-stony. Permeability is rapid, runoff is slow, and the erosion hazard is slight. The land capability unit is Class VII which are soils having very severe limitations that make them unsuited to cultivation and that restrict their use largely t:o pasture or range, woodland, or wildlife. The slope of the land ranges from 0 to 20 percent, and the annual rainfall is between 1.00 to 175 inches. A single family dwelling is presently situated on the front portion of the property. The. remaining area to the rear is presently overgrown and vacant. Within the immediate area, there are several parcels ti~iaich were rezoned for single family residential uses. Other lands in the vicinity are pastoral in character. Kawa.ilani Street, which provides access to the property, has a 40-foot right-of-way with a ~~® foot pavement. It is proposed to be widened to a 60-foot right-of-way. All essential utilities, including a 6-inch water line, are available: to the area. The Soil Conservation Service commented that the "Parcel is in a low area ar_d may be subject to localized flooding but does not appear to be of major concern with proper drainage." All other cooperating agencies, including the Department of Agriculture, had no comments on or objections to the subject request. - 2 - Ther_ are no historical features or identifiable landmarks attributed to the property. - 3 - Ail?
