BE ITIORDAINED BS' THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 11 of the Hawaii County Code is hereby rescinded. SECTION 2. The 1975 Edition of the National Electrical Code end the amer)dments proposed thereto, as evidenced in Exhibit 1, attached hereto and made a part hereof by reference, is adppt_ed as Chapter 11 of the Hawaii County Code. General Provisions SECTION 1. TITLE. This Chapter shall be known as the Electrical Code, may be cited as such, and is referred to herein as "this Code." SECTION 2. PURPOSE. The purpose of this Code is to reduce the hazards to persons and property from electrical causes. To accomplish this, the requirements set forth herein are intended to provide a minimum ;standard for electrical installations in the County of F3awaii. SECTION 3. SCOPE. The provisions of this Code shall apply to all electrical work and installations in the County, with excep- tions a.s covered by Section 90-2(b) of the 1975 National Electrical Code and the following: A. Electrical work on buildings or premises owned by or under the direct control of the United States. B. Electrical work by employees of a public utility within the Staite under a franchise or charter granted by the State which is regulated by the Public Utility Commission and community antenna televis>ion company, while so employed, pursuant to Section 448E-13, Hawaii Revised Statutes. C. The provisions of this Code shall not apply to a Municipal System for street lighting, traffic signal or police and fire alarm where installed outside of buildings on public property. Existing electrical installations which complied with the laws, ordinances acid regulations in effect when the electrical work thereon was performed, provided that such installations shall be subject to the pro~~isions of Subsection C of Section 4 hereof. F. Electrical work in accordance with the laws, ordinances and regulations in effect prior to the effective date of this Code under a permit therefor issued prior to such date. G. All buildings moved into or relocated within the County shall comply with +sll requirements of this Code for new buildings. H. Electrical work related to work regulated by Chapter 22 of Rule, XX of the Department of Labor and Industrial Relations of the State of Hawaii, relating to the Elevator Code, but not including electrical work fo:r the supply of power to the control panels of elevators, dumb-waiters, escalators, moving walks and man.lifts. I. Replacement or repair of devices and apparatus of air conditioning and refrigeration systems, except electrical work on overcuxrent devices which are not physically attached to, or physically mounted on, such systems. J. The construction, alteration or repair of electrical device:. commonly used in the home such as T.V, sets, radios, tape recorders, movie projectors and the like. Sf:CTION 4. INTERPRETATION-SAME SUBJECT MATTER. If there are two or more provisions in this Code or any other ordinance or statutE;s, covering the same subject matter, the provisions which providca the greater safety to life or limb, property or public welfare shall prevail. - 2 - ARTICLE 2. Definitions SE~~TION 1. DI'FINITIONS. The following words and phrases when used in this Code shall have the meaning respectively ascribed to them in this section, unless it is apparent from the context that a different meaning is intended. A. ADMIN]:STRATIVE AU'PHORITY, Whenever the term "Administrative Aut;hority" is used in this Code, it shall be construed to mean t;he Chief Engineer of Hawaii County Department of Public Works or his authorized representative. I3, ASSISTANTS. Whenever the term "assistants" is used in this Code, it shall be construed to mean the authorized representatives of the Administrative Authority. C, APPREIITICE. A person who performs electrical work under the dire=ct supervision and in the presence of a supervising electrician, supervising specialty electrician, journeyman electrician, journeyman specialty electrician. I), BOARD. The Board of Appeals. E, DEPA.R'.CMENT, The Department of Public Works of the County of Hawa:Li. 1?, ELECTRICAL CONTRACTOR, Any person who is licensed under the provisions of Chapter 444, Hawaii Revised Statutes, and poss~:ss a valid unexpired and unrevoked license qualifying him to ~~erform electrical work. G, ELECTRICAL SPECIALTY CONTRACTOR, Any person who is licensed under the provisions of Chapter 444, Hawaii Revised Statutes, and possess a valid unexpired and unrevoked license qualifying him to .perform electrical speciality work. H. ELECTRICAL WORK. The installation, alteration, reconstruction, or repair of electrical wiring. -3- I. ELECTRICAL WIRING. Any conductor, material, device, fitting, apparatus, appliance, fixture or equipment, con- stitutizig a part of or connected to any electrical installation, attached or fastened to any building, structure or premises and which i~zstallation or portion thereof is designed, intended or used to generate, transmit, transform or utilize electrical energy within the :cope and purpose of the National Electrical Code referred to ir. Section 1 of Article 5 of this Code. J. EME'RGE;NCY ELECTRICAL WORK. Repair of electrical wiring to restore electrical service to a building following a fire, remedy a power failure and protect persons and. property against short circuiting and open circuits. F., JOURNEYMAN ELECTRICIAN. Any person who has been licensed by the Board of Electricians and Plumbers as a journeyman electrician under t:he provisions of Chapter 448E, Hawaii Revised Statutes. L, JOURNEYMAN SPECIALTY ELECTRICIAN. Any person who has been licensed 2~y the Board of Electricians and Plumbers as a journeyman spe>_cialty electrician under the provisions of Chapter 448E, H<~waii Revised Statutes. PA, MAIDITENANCE WORK, The keeping in repair and operation of any electrical :installation, apparatus, fixtures, appliance or equipment. N. MOTIO]V PICTURE OPERATOR, Any person who has been licensed by the Bo~srd of Electricians and Plumbers as a motion picture operator under the provisions of Chapter 448E, Hawaii Revise. Statutes. 0. PERSON. Any individual, firm, partnership, association or corporation, provided that a firm, partnership, association or corporation are not included within the meaning of - 4 - person found in they definitions for journeyman electrician, journey- man specialty eleci~rician, supervising electrician, supervising speciality electric;ian, and motion picture operator. P, SUPERVISING ELECTRICIAN, Any person who has been licensed by the Bo~xrd of Electricians and Plumbers as a supervising electrician under {.he provisions of Chapter 448 F., Hawaii Revised Statutes. Q, SUPERVISING SPECIALTY ELECTRICIAN, Any person who has been licen,aed by the Board of Electricians and Plumbers a supervising specialty electrician under the provisions of Chapter 448E, Hawaii Revised Statutes. R. INUND:STION LEVEL. Maximum expected water level due to flooding by rainfall runoff, wind waves and tsunamis as established by the Administrative Authority. S. WATER-TIGHT. Reference to water-tight construc- tion below the inundation level shall mean constructed to exclude moisture and withstand the hydraulic gressure resulting from the anticii;ated depth of inundation. - 5 - ARTICLE 3. Administration and Enforcement SECTION 1. ADMINISTRATION AND EPTFORCEMENT. A. DEPARTMENT HAVING JURISDICTION. Unless otherwise provided f`or by law, the Department of Public 67orks of the County shall have jurisdiction over and administer all matters covered by this Cocl.e. B, RIGHT OF ENTRY, Whenever necessary to make an inspection to enfoY~ce any of the provisions of this Code, or whenever the Administrative Authority or his Assistant has reasonable cause to believe that there exists in any building, structure or premi:~es hazards to persons and property from electrical. causes, the Administrative Authority or his Assistant may enter such building, structure or premises at all reasonable times tc inspect tYie same or to perform any duty imposed upon the Administrative Authority by the Code; provided, that if such building, structure or premises are unoccupied, he shall first make a reasonable effort to locate the owner or other persons having chaz-ge or control of the building, structure or premises and demand entry. If such entry is refused, the Administrative Authority or his Assistant shall have recourse to every remedy provided by law to secure entry. c', INSPECTION AND PROCEDCTRES. 1, A]_1 electrical wiring, for which a permit is required, shall be inspected and approved by the Administrative Authority before being concealed, energized or used. A.11 fees required by this Code shall be paid by the permittee prior to the energizing or zzse of such wiring. - 6 - 2. No person shall use, operate or maintain, or cause or permit to be used, operated or maintained, any electric wiring until it is inspected and approved. 3. No serving agency shall supply, or cause or permit to be supplied, electric energy to any electric wiring until the wiring has been inspected and approved. R::CEPTION. Temporary construction services installed by the serving agency for temporary use, as prescribed under this Code ant to be used during construction only. 4. Dlo person shall conceal., enclose or cover, or cause or permit to be concealed, enclosed or covered, any portion. of any elec;tric wiring or equipment in any manner which will interfere with or prevent the inspection and approval thereof. 5. F:Lxtures, appliances, devices or equipment shall not be connected to any electric wiring until the rough electric wiring, i~icluding conductors have been inspected and approved, except a:a otherwise satisfactory to the Department. 6. A:Ll obstructions, covers, plates, tapes, etc., which zrakes impracticable the making of a thorough inspection of electric wiring shall be removed upon notice (either verbal or in writing) to do so, and shall be kept removed until the electric wiring has been inspected and approved. D. DEFECTIVE ELECTRICAL INSTALLATIONS. Whenever any electrical installation is found to have been installed, altered, changes'. or reconstructed contrary to the provisions of this Code ox' any other law, wherever any electrical installation is found to be in use contrary to the provisions of this Code or any other law, or whenever any electrical installation, which complied with the existing laws, ordinances and regulations 7 - in effect when the electrical work thereon was performed, is found to be unsafe or dangerous to persons or property, the Administrative Authority shall give the owner or the person in contro]. of such installation a written notice stating the findings with respect to such installation and order the owner or such other person to make th.e corrections to be set forth in such written notice. E. REQUEST FOR INSPECTION. Whenever any work regulated by this Code, or ar~y portion thereof, is ready for inspection, the Administrative Authority shall be notified by the person that same is ready for inspection. The notice shall be in writing on forms furnished by the Administrative Authority, or may be by telephone at the option of the Administrative Authority. The notice shall be fi:Led with the Department not less than 48 hours and not more than '72 hours before any such inspection is desired. 1. Tlie Administrative Authority shall proceed to inspect the samE= within 48 hours, not including Saturdays, Sundays or holiday:a, after receipt of such notice, and if said work conforms in a:Ll respects with the provisions of this Code, he shall attach a ~zotice granting authority to proceed with installations. 2. No electrical wiring shall be covered or concealed until the said 48 hours have expired after notice to the F,dministra- tive Authority has been received in his department, or until the Administrative Authority has approved the installation. and given permission to cover or conceal the same. Should the Adminis- trative Authority condemn any of said work. or equipment as not being i.n accordance with the provisions of this Code, notice in writing to that effect shall be given by him to the person engaged in the work. - 8 - 3. Within a reasonable time thereafter such work or equipment shall be altered or removed as the case may require, and necessary chancres shall be made so that all such work and equipment may fullg~ comply with the provisions of this Code before further wor}: is connected on or with such condemned work or equipment. In default, said Electrical Contractor shall be liable to the penalties provided in this Code, and any and every owner, contractor or other person engaged in construction of the building or structure, or otherwise, covering or allowing to be covered such portion of work or equipment, or removing any notice not to <:over same placed thereon by the Administrative Authority shall li}:ewise be liable to the penalties in this Code provided. F. FINAL INSPECTION REQUIRED. 1. No person shall use or supply electrical energy to any electrical installation on which electrical work was or is being perforrled under a permit issued pursuant to the provisions of this Code before the Administrative Authority has approved such '.nstallation. 2. W}ienever electric wiring has been approved, a certificate of inspection therefor shall be issued on demand, provided all fees required by this Code have been paid. 3. Ttie Supervising Electrician shall he present on job site upon t}ie request of the Administrative Puthority. SECTION 2. RESPONSIBILITY FOR COMPLIANCE. Every person installing, altering, repairing, using or maintaining electric wiring shall be re:aponsible for compliance with this Code. SECTIODI 3. NON-LIABILITY OF COUNTY FOE. DAMAGES. A. LIABI]~ITY OF PERSONS. This Code shall not be construed to relieve from or lessen the responsibility of such person - 9 - owning, operating or installing any electrical wires, appliances, apparatus, construction or equipment for damages to any one injured by any defect therein. B. NON-RESPONSIBILITY OF COUNTY. Neither the County of Hawaii, nor any department, board, commission, officer, employee, or the Administrative Authority thereof shall be held liable or responsible for any damage or injury caused by or resulting from the issuance of any permit issued, or any inspection or approval or issuance of a certificate of inspection, made under the provisions of this Code. - 10 - ARTICLE 4. Permits and Fees SECTION 1. PERMITS REQUIRED; EXCEPTIONS. A. PERMIT REQUIRED AND EXCEPTIONS. No person shall perform any electr9.ca1 work or cause or permit the same to be done, unless a permit therefor has been obtained from the Adminis- trative Authority with the following exceptions: 1. F.].ectric work and installations to which the provisions of this Code are expressly declared to be not applicable. 2, Installation of any portable motor or other portable appliance energized by means of a cord or cable having an attachment plug and, if such cord or cable is permitted by this Code. 3. Repair of any fixed motor or other appliance, or replacement of any fixed motor with another having the same horsepower rating rind situated at the same location, 4, Replacement of attachment plug receptacles, but not the outlet therefor. 5. M~iintenance work by a properly licensed electrician. 6. Emergency electrical work by a person to whom a permit may be is:oued. 7. Radio and television receiving antenna systems other than master or community systems in or about commercial and industrial bui]_dings, including hotels, multiple family dwellings, and apax•tment houses. 8. Sound recording systems for a single-family or two-family dwelling, 9. TYie provisions of the foregoing exceptions shall not apply to any repairs or replacements of electrical devices, apparatus,, or appliances which were originally installed - 11 - without. a permit w'nen such permit is required for the original instal7.ation, or when energized by, or which is a part of any hazardous or illegal wiring system. uirements 10. The foregoing exceptions from permit req shall not be deemed to allow any electric wiring to be done in a manner contrary to other provisions of this Code. g, SCOPG OF PERMIT. 1, The issuance of a permit is not an approval or an authorization of work specified therein. P, permit is merely an applic<tion for inspection, the issuance of which entitles the permittee to inspection of the work which is prescribed therein. royal 2, Neither the issuance of a permit nor the app by t3ze Administrative Authority of any document shall constitute an approval of any violation of any provision of this Code or of any other law or ordinance, and a permit or other document purporting to gave authority to violate any law shall not be valid with respect thereto. C. EMERGENCY WORK. When emergency electrical work is commenced without a permit, an application for a permit for the work shall be made pursuant to the provisions of Section 3 of Article 4 hereof as soon as possible after the work is conimenc ed . SECTION 2. SEPARATE PERPAITS. A separate permit shall be obtained for each building or structure, except that a permit for a main building may include electrical work for a private garage, shed, or accessory building located on the same premises as the main building, and supplied by a feeder or circuit from the main building. - 12 - SRCTION 3. APPLICATION FOR PERMIT. A. FILING, To obtain a permit, the applicant shall file an application. on forms furnished by the Administrative Authority. The application shall contain all information necessary to the Lawful enforcement of the provisions of this Code. F. PLANS AND SPECIFICATIONS. The application shall be accompanied by e~pproved plans and specifications or a suitable diagram when and a:> required by Section 4 of Article 4 hereof. C, ISSUANCE OF PERt4IT. When the Administrative Authority determines that the: information on the application and plans is in conformance with this Code, the Administrative Authority shall issue a perm:Lt upon receipt of the total fees. D, F.XCEP'CIONS. Nothing contained in this Code shall be construed to require the Administrative Authority to immediately accept or reject a:zy application, whenever it is necessary to investigate the pr~~posed wiring and premises as to its compliance with tYiis Code, or it is necessary to check_ plans and specifications accompanying the application. SF:C'I'ION 4. PLANS AND SPECIFICATIONS. Plans and specifications giving such details of the proposed installation as may be required by the Administrative Authority shall be filed with the application. Such p:Lans and specifications shall bear the approval of either a professional engineer registered in the State of Hawaii as especially qualified in the electrical branch of engineering, or a professional archit~:ct. or other' engineer registered in the State of Hawaii and qualified in such work by experience, provided that if the demand load of t:he proposed installation is less than thirty (30) kilovolt- amperes, this requirement shall be applicable only if the Adminis- trative Authority so directs. - 13 - No person shall materially deviate from any approved plan or spec:Lfications or fail, neglect or refuse to comply therewith, unless j~ermission to do so has first been obtained from the Department. SECTION 5. ISSUANCE. if the Administrative Authority is satisfied that the installation described in the application will conform to the provisions of this Code and all pertinent laws, and the fee prescribed in Section 10 of Article 4 hereof has been paid, he may .issue a permit to the persons specified in Section 6 of Article 4 hereof. SECTION 6. PERSONS TO WHOM PERMITS MAY BE ISSUED. A permit to do electrical work regulated by this Code may be issued only to: A. A home owner who performs electrical work on a single family Swelling which he will personally occupy and use exclusively for living purpose:>, provided such person is licensed under Chapter 448E, HRS, to perform such work, or will hire a person licensed under Chapter 448E, HRS, to perform such work. The owner shall note on the permit application the name and license number of the electrician and his address anc9 telephone number. Only one such permit may be issued to such a home owner, unless the Administrative Authority find that strict a~~plication would result in practical difficulty and hardship and t]Zat the granting of a second permit would not be contrary to the purpose of the Code. This does not preclude the home owner from obtaining additional permits for the same building or accessory building on the same lot. B. A contractor who is licensed under the provisions of Chapter' 444, Hawaii Revised Statutes, and possesses a valid, unexpiz•ed, unrevoked license which qualifies him to perform - 14 - electrical or electrical specialty work and who has a supervising electri~:ian or a supervising specialty electrician under his employment. C. A supervising electrician or supervising specialty electri~~ian 1. WY~o is employed as a maintenance electrician by someone other than a contractor described above; or 2. Who is donating his services to an eleemosynary institution for temporary electrical installation; or 3. WYio is employed by the County or State. SECTION 7. CONTENT; POSTING; WHEN NULL AND VOID. Every permit shall b~: issued in such form and detail as shall be prescribed by the Administrative Authority, shall specify the geographical location of the premises whereon the work authorized thereby is to be done, shall bs valid onl}~ for the location so specified, and shall be conspicuously posted by the holder thereof on the premises. If the work authorized by any permit shall be continuously suspended for a period of ninety (~30) days, such permit shall thereupon, and thereafter, be null and void. SECTION 8. TRANSFERABILITY. No permit shall be assigned, transferred or loaned to another by the person to whom it was issued. SECTION 9. SUSPENSION OR REVOCATION. The Administrative Authority may, in writing, suspend or revoke a permit issued under provisions of this Code whenever the permit has been issued in error or on the basis of incorrect information supplied, or in violation of any ordinance, regulation or provision of this Code permit fee shall not be refunded. In such event, the - 15 - SECTION 10. PERMIT FEES. A. TO WHOM PAID. A fee in accordance with the schedule set forth hereinaft=er shall be paid to the Director of Finance for each permit. B. Portable Electric Signs. A "portable electric sign" means a small advertis- ing contrivance ope>.rated with electricity and used in interior of buildings only which is capable of being moved or removed at will without darlaging or altering the structure or finish at or adjacent to i:he location thereof, and which is not attached or fastened in plat:e by nails, screws, bolts, conductors, wiring enclosures or in aziy other manner. No fee shall be required for such portable f~lectric signs when the outlet and circuit to which it is attached has been installed pursuant to a valid permit. 14. Lighting Fixtures. Temporary motor installations for carnival rides, k~tc., a flat fee of $10.00 shall be charged. 17. Generators, Capacitors, Reactors and Transformers Fixed. Fcr the purpose of this subsection. 1 KW i.s equivalent to 1 Y.VA. Nct more than 5 KW $ 4.00 Over 5 KW but not over 15 Kw 10.00 Over 15 KW :15.00 18. Miscellaneous. Each motion picture projection machine using 35 mm or larger film $10.00 Each X-Ray machine outlet 4.00 Each Dental Chair outlet 5.00 Ezich Electric Organ outlet 3.00 Each Electric Welder outlet 4.00 Erich Street Fighting Standard or fixture 3.00 For conduit and raceway installation, a fee of $3.00 shall be charged for each 500 square feet of floor area or any fraction thereof. (Fees are to be charged only when circuit oririncl is excluded.) 19. Repairs, alterations, additions. P.=_rmit fees for additions to or alterations of existing ~ti~ork sha1:L be the same as for new work. - ?.2 - Permit fees for repair or for work for which a permit: is required but for which no fee is herein provided shall be $3.00. C, WORK WITHOUT A PERDIIT, Where work for which a permit _is required by this Code is started or proceeded prior to obtaining of said permit, the fee shall be fifty dollars ($50.00:1 plus the fees specified by Subsection B above or the fees sp~acified by Subsection B above be doubled, whichever is greater, but payment of such fee shall not relieve any persons from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein. This provision does not apply to emergency work when proved to the sati:~faction of the Administrative Authority that such work was urgently necessary and it was not practical to obtain ~ permit therefor before the commencement of work, In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such a permit, the penalty will be charged. P. EXEMPTIONS. The County of Hawaii and all contractors performing work under authority of said County shall be exempt from the requirements to pay permit fees. SECTION 11. (:HARGES FOR EXTRA AND MISCELLANEOUS INSPECTIONS. A. EXTRA INSPECTIONS. If, after notice to a permit holder, more than one inspection is necessary to insure that deficient or defective electrical work under the permit has been corrected, the holder of the permit shall pay the Director of Finance twenty dollars ($20,00) for each additional inspection. - 23 - P.. MISCELLANEOUS INSPECTIONS. For the inspection of any electrical installation, not covered by a fee specified in this Code, the I>erson requesting the inspection shall pay the Director of Finance fifteen dollars ($15.00) for each hour or portion thereof that is required to make the inspection and travel to and from the installation. - 24 - ARTICLE 5. Standards SECTION 1. STANDARDS FOR ELECTRICAL WORK. A. ADOPTION OF THE NATIONAL ELECTRICAL CODE. The Nationa_ Electrical Code, 1975 Edition, copyrighted 1974 by the Nationa:_ Fire Protection Association, 60 Batterymarch Street, Boston, Massachusetts, 02110, i_s hereby adopted by reference and made a part hereof. Three copies of said Code shall be kept on file and be available for public inspection in the County Clerk's Office. The scope, technical specifications and exemptions set forth iii said Code are hereby adopted as the standard for electrical work co~~ered by the Code, provided there are no specific provision in any othEar section of this Code covering the particular mat*_er. R. COMPLIANCE REQUIRED. No person shall do or cause to be d~~ne any electrical work which does not comply with the provisi~~ns of this Code. SECTIOP] 2. STANDARDS FOR PERFORMANCE OF ELECTRICAL WORK. No person shall perform any work covered by this Code in violation of the pro~aisions of Chapter 448E, Hawaii Revised Statutes. SECTION 3. QUALIFICATION OF PERFORMANCE OF WORK UNDER THE ELECTRICAL CODE. A. Compliance with the Hawaii Revised Statutes: It shall be unlawful f.'or any permittee to perform or allow to be performed any work covered by the permit issued under this Code in violation of Cheipter 444, Hawaii Revised Statutes, relating to the licensing oi` contractors, and Chapter 448E, Hawaii Revised Statutes, relating to the licensing of electricians and plumbers. B. Any pEarson engaged in a business involving performance of electrical work covered by this Code, shall maintain a place - 25 - of business in a business or industrial zone in accordance to the pro~~isions of Zoning Ordinance No. 63 of the County of Hawaii, with a :_isted telephone number and be principally engaged in said buc~iness during the normal business hours for said place of business. SE(:TION 4. APPEALS AND PETITIONS. Any appeal from the decision of the Administrative Authority in the administration of the County of Hawaii Electrical Code involving any denial of the use of new or alternate materials, types of construction, equipment, fixtures, devices or appliances, or any petition for varying the application of the ];lectrical Code may be submitted to the Board of Appeals for hearing and determination as specified in Section 204, [Jniform Building Code, as amended, under Section 6, Ordinance 93 of the Revised Ordinance cf the County of Hawaii 1975, as amended. SECTION 5. PENALTY. Any person, firm or corporation violating, or failing to comply with any of the provisions of this Code, shall upon conviction thereto be punished by a fine not exceeding Five Hundred Dollars ($500.00). Each separate day or portion thereof during which any violation of this Code occurs or continues shall be deem=_d to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. SE+3TION 6. OFFENSES UNDER FORMER ORDINANCES SAVED. Nothing contained in any provision of this ordinance shall apply to an act done or omitted, or' to an offense committed at any time before the enactment of this ordinance. Such act or omission shall be governed by, and any such oi`fense shall be punished according to the provi- sions of the ordinecnces existing when such act, omission or offense, occurred in the sane manner as if this ordinance had not been enacted. - 26 - ARTICLE 6. Amending the National Electrical Code SECTION 1. AMENDING SECTION 210-8 OF THE NATIONAL ELECTRICAL CODE. Section 210-~8 is amended by deleting paragraph (b) thereof. SECTION 2. AMENDING SECTION 600-4 OF THE NATIONAL ELECTRICAL CODE. Section 600-~4 is amended to read: "Every electric sign of any type, fixed or portable, shall be listed or approved. EXCEPTION: Such approval will not be required provided: 1. The sign is constructed and assembled of approved components in accordance with recognized standards. 2. TYie sign is inspected and approved before erection." SECTION 3. AMENDING THE NATIONAL ELECTRICAL CODE. The National f:lectrica]. Code is amended by adding the following: "Rain WatEar and Sea water Flooding Standards. The following paragrapYis shall supplement the requirements of the National Electrical. Code for electrical work subject to inundation by rainfall run-offs or sea waves: ]. Services: a. Location. Service Equipment shall be located above the inundation level or shall be installed in water-tight enclosure, room, or vault, anal shall be readily accessible in any case. b. Ground Fault Protection. Ground fault protection shall be provided i'.or all grounded wye electrical services. 2. Ground Fault Protection: a. AYEproved ground fault circuit protection shall be provided for all ff~eder and branch circuits below or extending into inundation level. - 27- 3. Wirinc Method and Material: a. Distribution Equipment. Rquipment such as trans- formers, fuses, par~elboards, switchboards, disconnects, circuit breakers, controllers and other devices used for control, disconnect- ing mea:as, ground fault protection, or overcurrent protection shall be located above the inundation level, unless made of water-tight construction. 4. The CY~ief Engineer shall have the authority to consider exception=_~ to the provisions of the requirements of this Section and may grant variance from the provisions thereof, if local topographic conditions clearly indicate that the possibility of flooding is not present." - 28 - in said ordinance shall be construed as continuations or amendments of applicable or corresponding provisions of previously existing laws and not as new enactments. PERSONS TO WHOM PERMITS b'1AY BE ISSUED, A permit to do electrical work regulated by this Code may be issued. only to: A, A home owner who performs electrical work on a single family dwelling which he will personally occupy and use exclusively for living purposes, provided such person is licensed under Chapter 448E, HRS, to perform such work, or will hire a person licensed ixnder Chapter 448E, HRS, to perform such work. The owner shall noise on the permit application the name and license number of t:he electrician and his address and telephone number. Only one such permit may be issued to such a home owner, unless the Administrative Authority find that strict application would result in practical difficulty and hardship and that the granting of a secor..d permit would not be contrary to the purpose of the Code. This does not preclude the home owner from obtaining additional. permits for the same building or accessory building on the same lot. B, A supervising electrician or supervising specialty electrician: 1. Who is an electrical contractor or electrical specialty contractor; or - 14 - 2, TNho is employed by an electrical contractor or electrical specialty contractor for work of the electrical contractor or electrical specialty contractor; or 3. W'ho is employed as a maintenance electrician by someone other than an electrical contractor or electrical specialty contractor; or 4. Who is donating his services as an electrician or specialty electrician to an eleemosynary institution in connec- tion w:Lth electrical installations of a temporary nature; or 5. Who is applying for a permit for electrical or specialty electrical work for his own dwelling, 6. Who is employed by the County or State. SECTION 7. CONTENT; POSTING; WHEN NULL ARID VOID. Every permit shall k;e issued in such form and detail as shall be prescribed by the Administrative Authority, shall specify the geographical location of the premises whereon the work authorized thereby is to be done, shall k;e valid only for the location so specified, and shall be conspicuously posted by the holder thereof on the premises. If the work authorized by any permit shall be continuously suspended for a period of ninety (90) days, such permit shall thereupon, and thereafter, be null. and void. SECTION 8. TRANSFERABILITY. No permit shall be assigned, transferred or loaned to another by the person to whom it was issued. SEICTION 9. S!JSPENSIOD? OR. REVOCATION. The Administrative Authority may, it writing, suspend or revoke a permit issued under provisions of this Code whenever the permit has been issued in error or on the basis of incorrect information supplied, or in violation of any ordinance, regulation or provision of this Code.
