'~~ AN ORDINANCE ~ MAP, CHAPTER I CHANGING THE I TURAL (A-5a) 1 MAP KEY 5-5-OE BE IT SECTION MENDING SECTION 7.06, THE NORTH & SOUTH KOHALA DISTRICTS ZONE (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY xSTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO AGRICUL- P KAAUHUHU HOMESTEADS, NORTH KOHALA, HAWAII, COVERED BY TAX :3. BY THE COUNCIL OF THE COUNTY OF HAWAII: Section 7.06 of Chapter 8 (Zoning Code), Article 2, Hawaii County~Code, as amended, is hereby further amended by adding thereto the following subsection: "7. Q6 (o ). The district classification of the following area situated~at Kaauhuhu Homesteads, North Kohala, Hawaii, shall be Agricultural (A-Sa): Beginnin at a 1-1/2 inch pipe at the southeast corner of this lot and the ortheast corner of Lot 79, the coordinates of said pipe referred to the Government Survey Trig. Station "PUU-O-NALE" being 15227.2 eet North and 4671.2 feet East, as shown on Government Survey R gistered Map No. 2579, and running by true azimuths: 1. 90° 2. 190° 3. 270° 4. 6° 00' 1281.6 feet along Lot 79 to a 1-1/2 inch pipe; 30' 531.4 feet along Hoea Road to a 1-1/2 inch pipe; 00' 1245.0 feet along Lot 81 to a 1-1/2 inch pipe; 35' 526.0 feet along Homestead Road to the point of beginning and containing an area of 15-15/100 Acres or thereabouts. as outlined in red on the map attached hereto, marked Exhibit 1A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the cond~,tions that (A) the applicant, Gilbert McConnell, submit a subdivision pan and secure tentative approval within one (1) year from the date of a option of the change of zone. The applicant shall also be responsible fc~r securing final subdivision approval; (B) a minimum of fifty percent (50~)~of the proposed 10-acre lot be put into agricultural produc- tion within f ve (5) years of receipt of final subdivision approval. Agri- cultural production is defined as active production of crops or livestock for purposes deriving :Lncome. Twenty-five percent (25~) of the individual(s)/ firm(s) gross income must be derived from agricultural production from the use of this particular land. This condition shall apply to whomever holds title of the land. Prior to the five (5) year period, the applicant or whomever holds title to the land shall file a progress report to the Plan- ning Department which wi1:L include, but not be limited to, the number of acres used for agricultural purposes, types of agricultural activities conducted, and income der:Lved from agricultural production. Further, the applicant will include in his deed for the proposed 10-acre lot, the follow- ing clause of onveyance: "AND the grantees for themselves, their heirs, administrators, and assigns, do hereby covenant with the grantor that the above describe premise will be put into agricultural production within five (5) years. Such agricultural use will consist of a minimum of fifty percent (50~) f the above: described lot, and that twenty-five percent (25~) of the individ al(s)/firm(s) gross income will be derived from the agricul- tural producti n of the ak~ove described lot." Such agreement shall be filed with the Bureau of ('onveyance, the Office of the Corporation Counsel, and the Planni g Department; and (C) that access to the proposed 10-acre lot shall be f om Cambra Ftoad. Should any of the foregoing conditions not be met, rezoning of the px-operty to its original zoning designation may be initiated. SECTION ~. In the event that any portion of this ordinance is declared inval~d, such invalidity shall not affect the other parts of this ordinance. -2- SECTION 4. This ordinance shall take effect upon its approval.
