ORDINANCE NO. N05
AN ORDINANCE AMENDING CHAPTER 3, ARTICLE 3, SECTION 11,
HAWAII COUNTY CODE, AS AMENDED, RELATING TO SP£sCiAL FIBF3CBACKERS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 3, Article 3, Section 11, relating
to special firecrackers, is amended as follows:
"SEC. 11. SPECIAL FIRECRACKERS
"SEC. 11.01. SALE. It shall be unlawful for any
person to offer for sale, sell, or give any special
firecrackers to minors below the age of 18 years, and
for any minor below said age to possess, purchase or fire
any special firecrackers or fireworks except as noted in
Sec. 11.02 hereof. Retail sale(s) of special fireworks
shall be limited to the period starting from the last
day of public school before Christmas and ending on
New Year's Eve and one WP_E?k prior to and including Chinese
New Year's Day and the Fourth of July.
"SEC. 11.02. LIABILITY OF PARENTS OR GUARDIANS.
The pareni:s, guardian and other persons having the custody
or control of any minor under the age of 18 years, who
knowingly permit such minor to posess, purchase or fire
any special firecracker shhall be deemed to be in violation
of this article and shall be subject to penalty thereunder,
except the parents or guardian may allow such minor to use
any special firecrackers while under his immediate
supervision and control or under the supervision and control
of any other adult.
"SEC. 11.03. PERIOD OF USE. Special firecrackers
may be used, subject to the exceptions in Sections 8, 9,
and 10 of this article as follows:
"New Year's Eve. From 7:00 p.m. to 2:00 a.m.
"New Year's Day. From 7:00 a.m, to 7:00 p.m.
"Chinese New Year' s Eve. From 7:00 p.m. to 2:00 a.m.
"Chinese New Year's Day. From 7:00 a.m. to
7:00 p.m.
"Fourth of July. From 7:00 a.m. to midnight.
"It shall be unlawful for any person to throw, set off,
fire or cause to be exploded any special

period of one week prior to Fourth of July.
Exception. On New Year's Eve, Chinese New Year's
Eve and the Fourth of July, special firecrackers may
be used until 2:00 a,m, following those days.
"It shall be unlawful for any person to throw, set off,
fire or cause to be exploded any special firecrackers
between the hours of 7:00 p.m, and 7:00 a.m. each night of
authorized use. Further, the limitations of this section
shall not be applicable to the discharge of fireworks
pursuant to Section 5 or 6 hereof.
"SEC 11.04. It shall be unlawful for any individual
to set off, fire or cause to be exploded any fireworks in
any school, school grounds or school yards on any occasion.
Any violation of this section shall be constituted to be a
misdemeanor subject to a. fine of $500 or six months
imprisonment or both."
