AN ORDINANCE TO AMEND CHAPTER 2 OF THE HAWAII COUNTY CODE, 1983
(1995 EDITION) AS AMENDED, TO ALLOW THE NEGOTIATED DISPOSITION OF
REAL PROPERTY FOR AFFORDABLE HOUSING PROJECTS
BE [T ORDAINED BY THE COLTICIL OF THE COUNTY OF HAWAII
Section I Findings Section 2-120 (a) (2), of the Hawaii County Code allows the
finance director to negotiate the leasing of real property to nonprofit organizations,
Section 2-120 (a) (3), of the Hawaii County Code allows the finance director to negotiate the
exchange of real property to nonprofit organizations, Section 2-120 (a) (4), of the Hawaii
County Code allows the finance director to negotiate the granting of licenses, permits and
easements to nonprofit organizations, the Hawaii County Housing Agency is seeking to
amend Section 2-120 (a) (2), of the Hawaii County Code to allow the finance director to
negotiate the selling in fee simple of real property to develop affordable housing
Section 2 Chapter 2, Section 120 (a) (I of the Hawaii County Code 1983 (1995
Edition) is amended to read as follows
Section 2-120 Disposition to government, governmental agencies, nonprofit
organizations, and affordable housing developers
(a) Notwithstanding any limitations to the contrary, the council may, by
resolution approved by a maJonty of its members, direct the finance
director to negotiate the disposition of real property by
(I) Selling tt in fee simple at such puce and on such teens and
condtttons deemed proper to govenments and governmental
agenctes authonzed to hold lands to fee simple, to nonprofit
organtzattons to develop affordable housing, or affordable housing
developers,
(2) Leasing it to governments, governmental agenctes, nonprofit
organizations, or affordable houstng developers at such rentals and
on such terms and condtttons as deemed proper,
(3) Exchanging tt for real property owned by govetments,
goveimental agenctes, nonprofit organtzattons, or affordable
houstng developers
(4) Granting licenses, petTrtits, and easements to governments,
governmental agenctes, nonprofit organtzattons, or affordable
houstng developers on such tetms and condtttons as deemed proper

Sectton 5 Severabtltty If any provtston of this ordinance, or the appltcatton thereof
to any person or circumstance, is held tnvaltd, such invalidity shall not affect other provtstons
or applications of the ordtnance which can be given effect without the tnvaltd provtston or
appltcatton, and to this end the provtstons of this ordinance are severable
Secnon 6 This ordinance shall take effect upon us approval
