ORDINANCE NO. 2''64
AN ORDINANCE AMENDING ORDINANCES NOS. 46, 82, AND 211, ALL
RELATING TO PUBLIC IMPROVEMENT AND FINANCING THEREOF FOR
THE FISCAL YEARS JULY 1, 1974 TO JUNE 30, 1975, AND JULY 1, 1976
TO JUNE 30, 1977.
WHEREAS, in Ordinance No. 46, relating to public improvement
and financing thereof for the fiscal year July 1, 1974 to
June 30, 1975, an amount of $300,000 was appropriated by the
Hawaii County Council to the "'Kua Bay Beach Park" project;
and
WHEREAS, in Ordinance No. 82, an ordinance amending
Ordinance No. 46, an additional amount of $200,000 was
appropriated by the Hawaii County Council to the "Kua Bay
Beach Park" project; and
WHEREAS, Ordinance No. 2:11 relates to public improvements
and financing thereof for fiscal year July 1, 1976 to June 30,
1977; and
WHEREAS, the Hawaii County Council desires to amend
Ordinances Nora. 46 and 82 by deleting the "Kua Bay Beach
Park" project and the appropriations of $500,000, and to
amend Ordinance No. 211 by creating a "Contingency Fund" and
transferring the $500,000 into said fund; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 2 of Ordinance No. 46 is hereby
amended by deleting project entitled "Kua Bay Beach Park"
and the appropriation of $300,000.
SECTION 2. Section 2b of Ordinance No. 82 is hereby
amended by deleting project entitled "Kua Bay Beach Park"
and the appropriation of $200,000.
SECTION 3. Section 2 of Ordinance No. 211 is hereby
amended by adding a category entitled "CONTINGENCY FtJND"
and transferring the appropriation of $500,000 from the
"Kua Bay Beach Park" project into the contingency fund,
which amendment is to be placed below "GRAND TOTAL" and is
to read:
"CONTINGENCY FUND 500"
SECTION 4. Ordinance No. 211 is further amended by
making the present "SECTION 6" to read "SECTION 7" and
replacing the present "SECTION 6" by a new section, which
sections 6 anal 7 are now to read:
"SECTION 6. The Contingency Fund is hereby
appropriated to the Mayor's Office to be used only
as directed, by resolution effective immediately
upon adoption, by the Hawaii County Council.
"SE'CTION 7. This ordinance shall take effect
on July 1, 1976."
SECTION 5. This ordinance shall take effect upon its
approval.
