HomeMy WebLinkAboutORD 1977-277 1976-1980BILL No. 3~3 (Revised) COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. /~+~~ AN ORDINANCE AMENDING SECTION 7.02 THE NORTH KONA ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM UNPLANNED (U) TO AGRICULTURAL (A-la) AT OOMA 1ST, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-3-05:17. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.02 (rr). The district classification of the following area situated at Ooma 1st, North Kona, Hawaii, shall be Agricultural (A-la): Beginning at the most southerly corner of this parcel of land, on the westerly side of Hawaii Belt Road (FAP F-10[5]), the coordinates of said point of beginning referred to Government Survey Triangulation Station "MOANUTAHEA" being 9,419.16 feet South and 8,492.37 feet West and running by azimuths measured clockwise from true south: 1. 96° 37' 654.53 feet along the remainder of Grant 3822 to J. Palakiko to a point; 2. 1780 14' 166.21 feet along Grant 3804 to Hoolapa to a point; 3. 276° 53' 632.8() feet along the remainder of Grant 3822 to J. Palakiko to a point; Thence, Following along the westerly side of Hawaii Belt Road (FAP F-10 j5]), on a curve to the left with a radius of 2,934.79 feet, the chord azimuth and distance being: 4. 350° 43' 49" 167.9() feet to the point of beginning and containing an area of 2.404 acres . "All as outlinedin red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect Forthwith upon the conditions that (A) the petitioners or their authorized representative, submit a subdivision plan and secure tentative approval within one (1) year from the effective date of adoption of the change of zone. The petitioners/ representative shall also be responsible f'or securing final subdivision approval; (B) at least one (1) of the proposed lots shall be put into agri- cultural production. Agricultural production is the active use of the land for agricultural purposes, and in accordance with the State Land Use Com- mission's definition of agriculture; (C) the rules, regulations, and require- ments of the County Department of Water Supply shall be complied with; (D) only one (1) access to serve both lots shall be permitted from the Hawaii Belt Highway; and (E) that all other applicable rules and regulations shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
