N~8 AN ORDINANCE AMEDTJING SECTION 7.18, THE PUNA DISTRICT ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE ~, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM OPEN (O) TO AGRICULTURAL (A-la) AT KEAAU, PUNA, HAWAII, COVERED BY TAX MAP KEY 1-5-16:89-98, 103-112 & 1-5-23:176-183, 204- 212, 229-237, 244-251. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.18 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsections: "7.18 (h-1). The district classification of the following area situated at Keaau, Puna, Hawaii, shall be Agricultural (A-la): Beginning at the West corner of this parcel of land, being also the West corner of Lot 69, the South corner of Lot 68 and the northeasterly side of Lot 1560 (40-ft. road) and running by azimuths measured clock- wise from true South: 1. 220° 32' 48" 322.67 feet along Lot 68, Block 9, Land Court Application 1053 (Map 64); 2. 310° 32' 48" 1080.00 feet along Lots 100 to 107, inclusive, Block 9, Land Court Application 1053 (Map 64); 3, 40° 32' 48" 322.67 feet along Lot 77, Block 9, Land Court Application 1053 (Map 64); 4. 130° 32' 48" 1080.00 feet along Lot 1560, Block 9, Land Court Application 1053 (Map 64) to the point of beginning and containing an area of 8.00 Acres. "7.18 (h-2). The district classification of the following area situated at Keaau, Puna, Hawaii, shall be Agricultural (A-la): Beginning at the West corner of this parcel of land, being also the West corner of Lot 27, the South corner of Lot 25 and the northeasterly side of Lot 1559 (40-f t. road) and running by azimuths measured clockwise from true South: 1. 220° 32' 48" 645.34 feet along Lot 25 and Lot 26, Block 9, Land Court Application 1053 (Map 64); 2. 310° 32' 48" 1215.00 feet along Lot 1560 (40-f t. road), Block 9, Land Court Application 1053 (Map 64); 3. 400 32' 48" 645.34 feet along Lot 46 and Lot 45, Block 9, Land Court Application 1053 (Map 64); 4. 1300 32' 48" 1215.00 feet along Lot 1559 (40-f t. road), Block 9, Land Court Application 1053 (Map 64) to the point of beginning and containing an area of 18.00 Acres. Th is district classification of the following area situated at Keaau, Pu na, Hawaii, shall be Agricultural (A-la): Beginning at the West corner of this parcel of land, being also the West corner of Lot 204, th e South corner of Lot 205 and the northeasterly side of Lot 15 08 (40-f t.) road) and running by azimuths measured clockwise from true South: 1. 2200 32' 48" 645.34 feet along Lot 205 and Lot 248, Block 8, Land Court Application 1053 (Map 60); 2. 3100 32' 48" 1350.00 feet along Lot 1508 (40-f t. road), Block 8, Land Court Application 1053 (Map 60); 3. 400 32' 48" 645.34 feet along Lot 259 and Lot 194, Block 8, Land Court Application 1053 (Map 60); 4. 1300 32' 48" 1350.00 feet along Lot 1508 (40-f t. road), Block 8, Land Court Application 1053 (Map 60) to the point of beginning and containing an area of 20.00 Acres. - 2 - "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1. of this ordinance shall take effect forthwith upon the condition that all applicable rules and regulations of the Agri- cultural 1-acre (A-la) zoned district shall be complied with. Should the foregoing condition not be met, rezoning of the area to its original zoning designation may be initiat:ed. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
