""®a5 AN ORDINANCE AMENDING SECTION 7.04 THE KAI:LUA URBAN ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM MULTIPLE FAMILY RESIDENTIAL (RM-1) TO VILLAGE COMMERCIAL (CV-7.5) AT HONUAULA, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-22:28. BE IT ORDAINED BY THE COUNCIL OF THE COUN7.'Y OF HAWAII: SECTION 1. Section %. 04 of Chapter Fi (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.04 (m ). The district classification of the following area situated at Honuaula, North Kona, Hawaii, shall be Village Commercial Beginning at the North corner of thi:> piece of land, the East corner of Lot 60 and on the Westerly side o:E Kalawa Street, the coordinates of said point of beginning referred to Government Survey Triangulation Station "NORTH MERIDIAN"being 1089.5.1 feet South and 1366.01 feet East and running by true azimuths measured clockwise from South: 1. 331° 59' 62.50 feet along the Westerly side of Kalawa Street; 2. 610 59' 120.00 feet along the Northerly side of L,ot 58; 3. 1510 59' 62.50 feet along the Easterly side of Lot 50; 4. 2410 59' 120.00 feet along the Southerly side of Lot 60 to the point of beginning and containing an area of 7,500 square feet. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) development of the area shall commence within one (1) year from the effective date of approval of the change of zone and be completed within two (2) years thereafter (B) the sewer easement shall be delineated at another section of the property, meeting the approval of the Department of Public Works, Bureau of Sewers and Sanitation; (C) any access from Kuakini Highway shall meet with the approval of the State Department of Transportation, Highways Division; (D) the petitioner shall resurface the existing 14-foot pavement to Kalawa Street, meeting the approval of the Department of Public Works; and (E) all other applicable rules and regulations, including the Plan Approval x>rocess shall be complied with. Should any of the foregoing conditions noi; be met, the rezoning of the area to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
