N96 AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2,. HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO AGRICULTURAL (A-l0a) AT PONAHAWAI AND KAUMANA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-5--02:PORTION OF 9. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.29 (ddd). The district classification of the following area situated at Ponahawai and Kaumana, South Hilo, Hawaii, shall be Agricultural (A-l0a): Beginning at a pipe at the northeast corner of this parcel of land, on the west aide of Homestead Road, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAI" being 11204.60 feet. South and. 2297(1.80 feet West and running by azimuths measured clockwise from True South: 1. 359° 53' 2420.!i0 feet along Homestead Road to a pipe in concrete; 2. 63° 50' 439.30 feet along Government Land; Thence along the northeast side of Kaumana Drive for the next fourteen (14) courses, the azimuths and distances between points being: 3. 98° 57' 20" 240.55 feet; 4. 98° 06' 207.70 feet; 5. 106° 08' 26.45 feet; 6. 126° O5' 30" 214.28 feet; 7. 139° 54' 30" 141.1.5 feet; 8. Thence along a curve t_o t825rO0hfeetththerchord of azimuth and distance being: 145° 46' 45" 168.77 feet; 9. 151° 39' 115.66 feet; 10. Thence along a curve to the left with a radius of 435.00 feet, the chord aa~znuth and distance being: 140° 14' 15" 172.15 feet; 11. 128° 49' 30" 128.22 feet; 12. 129° 57' 218.99 feet; 13. 126° 20' 240.94 feet; 14. Thence along a curve to the right with a radius of 1259.74 feet, the chord azimuth and distance being: 127° 41' 15" 59.54 feet; 15. Thence along a curve to 'the left with a radius of 1225.00 feet, the chord azimuth and distance being: 117° 31' 15" 489.32 feet; 16. 106° 00' 107.01 feet; 17. 175° 58' 686.84 feet along Government Land to a pipe in Ahu; 18. 279° 50' 1341.90 feet along Lot 24-A (Grant 4667 to George T. McFarlan) to a 1-1/2" pipe in concrete; 19. 234° 35' 1415.90 feet along Lot 24-B (Grant 4656 to J. R. McFarlan) to the point of beginning and containing an area of 83.6654 Acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the petitioner or his authorized representative submit a subdivision plan and secure tentative approval within one (1) year from the effective date of adoption of the change of zone request. The petitioner/ representative shall also be responsible for securing final sub- division approval; (B) at the time of subdivision approval, water requirements of the Department of S9ater Supply shall be complied -2-- with; (C) the petitioner/representative shall submit together with the subdivision plans, plans for flood control measures; (D) at least three (3) of the proposed lots shall be put into agricultural production. Agricultural production is defined as the actual use of the land for agricultural purposes, and in accordance with the State Land Use Commission's definition of agriculture. Upon subdividing the land, the petitioner shall incorporate into any deed, lease, <~greement of sale, mortgage or other instrument of conveyance covering any portion or all of the subject lands the condition and restriction on uses as prescribed in Part III, Section 3-:3 of the State Land Use District Regulations. These encumk~rances shall run with the lands until such time that the lands are reclassified to a Land Use District other than Agricultural. A copy of the deed to be recorded shall be submitted to t:he Planning Department no later than six (6) months from the date of final approval of the subdivision; (E) the subdivision plans be designed to minimize direct access from each of the lot:> onto the Saddle Road and shall take into consideration the ].20-foot road right-of-way reserve for the Puainako extension/Saddle Road improvements. The roadway layout, including accesses to the proposed lots, shall be evaluated at the time of subdivision review; and (F) all other applicable rules and regulations shall be complied with. Should any of the foregoing conditions not. be met, the rezoning o:E the area to its original designation ma.y be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. -3- SECTION 4 approval.
