AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 2, SECTION 2.02
HAWAII COUNTY CODE, AS AMENDED, RELATING Ta REFUND OF PERMIT FEES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 2.02 of Article 2, Chapter 2, Hawaii
County Code, is hereby amended to read as follows:
"SECTION 2.02 REFUND OF PERMIT FEES. Director of Finance
authorized to grant refund of permit fees.
The Director of Finance of the County of Hawaii is hereby
authorized to grant the refund of permit fees according to and
in compliance with the provisions of this ordinance in any case
not covered specifically by any other law or ordinance.
A. Written request required; contents of request; time
limit.
Any person, firm, corporation or organization who has
paid a fee established 'by the County for the issuance of
any permit shall be entitled to a refund of such fee;
provided, that said person, firm, corporation or organization
first submits a written request to the Director of Finance
identifying the issue date, amount, and nature of the
permit; and provided further, that said request is
received by the Director of Finance within [sixty (60)]
ninety (90) days from the issue date of the permit.
B. Submission of request to responsible agency for
confirmation; amount of refund; minimum charge to be retained
by County.
Upon receipt of a written request for a refund, the
Director of Finance shall record the date of receipt.
thereupon, and shall forward said request to the department
or agency deemed responsible for the issuance of the permit.
Said department or agency shall confirm or deny the informa-
tion contained in the request. pertaining to the issue date,
amount, and type of the permit, and shall notify the
Director of Finance of its findings.
If the Director of Finance is satisfied that the request
was received within the [sixty (60)] ninety (90) day time
limit specified hereinabove, he shall refund to the
applicant his permit fee less the greater of the amount
of ten per cent (10%) of the fee or Five Dollars ($5.00)
[, whichever is greater].
C. No refund for fees of Five=_ ($5.00) or less.
No refunds shall be granted for any fee equal to or
below the amount of Five Dollars ($5.00).
D. Refund of duplicate fees.
Notwithstanding the 90-day time limitation for requests
and the amount of refund, the Director of Finance may refund the
full amount of a permit that was inadvertently issued in duplicate "

need not 'be included in prin ting t:his ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
