ORDINANCE NO. 3~J
AN ORDINANCE AMENDING CHAPTER 2 (ADMINISTRATIVE CODE), AS AMENDED, BY
DESIGNATING A CENTRAL COORDINATING AGENCY FOR THE COUNTY OF HAWAII.
BE IT ORDAINED BY THE COUNCIL OF THE COiJNTY OF HAWAII:
SECTION 1. Authority and Purpose.
This ordinance is adopted pursuant to authority conferred by Chapter
46, Hawaii Revised Statutes, as amended by Act 74, Session Laws of Hawaii,
1977. The purpose of this ordinance is to improve the coordination and
efficiency of the land use and planning control systems.
SECTION 2. Chapter 2, Article 2, Section 3.07 is hereby renumbered
to Chapter 2, Article 2, Section 3.08.
SECTION 3. Chapter 2, Article 2, :is hereby amended by adding thereto
the following section:
"Section 3.07. CENTRAL COORD'INATING AGENCY
A. Designation.
Pursuant to Chapter 46, Hawaii Revised Statutes, as
amended, the Planning Department is hereby designated the
central coordinating agency for the County of Hawaii.
B. Powers, Duties and Functions.
The central coordinating agency shall:
(1) Maintain and continuously update a repository
o£ all laws, rules and regulations, procedures,
permit requirements and review criteria of all
Federal, State, and County agencies having con-
trol or regulatory powers over land development
projects within the County and shall make said
repository and knowledgeable personnel available
to inform any person requesting information as
to the applicability of the same to a particular
project within the County.
(2) Study the feasibility and advisability of utili-
zing a master application form to concurrently
file applications for an amendment to a general
plan, change in zoning, special management area
permit and other permits and procedures required
for land development projects in the County to
the extent practicable with one master application.
C. Rules.
The central coordinating agency shall compile the re-
pository required by subsection B and adopt necessary
rules pursuant to Chapters 46 and 91, Hawaii Revised
Statutes, as amended, by December 31, 1977.
D. Applicability.
All State and County departments, divisions, agencies
and commissions, with control or regulatory powers over
land development projects within the County shall co-
operate with the central. coordinating agency in making
available and updating information regarding laws, rules
and regulations, procedures, permit requirements and re-
view criteria they enforce upon land development projects.
The term "agency" shall be as defined by Chapter 91, Hawaii
Revised Statutes.
E. Appeals.
Appeals from actions by the Director of Planning in
the administration of the rules and regulations adopted
pursuant hereto shall be appealable to the Planning Board
of Appeals. An appeal shall be sustained only if the
Planning Board of Appeals finds that the Director's action
was based on an erroneous finding of material fact, or
that the Director had acted in an arbitrary or capricious
manner, or had manifestly abused his discretion."
SECTION 4. Validity.
The validity of any word, section, clause, paragraph, sentence, part
or provision of this ordinance shall not affect the validity of any other
part of this ordinance which can be given effect without such invalid part
or parts.
SECTION 5. Effective Date.
This ordinance shall take effect upon its approval.
