BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.09 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended is hereby further amended by adding thereto the following subsection: "7.09 ( i ). The district classification of the following area situated at Waimea Homesteads, South Kohala, Hawaii, shall be Single Family Residential (RS-15): Beginning at a point at the Southwest corner of this parcel of land on the North side of Hokuul.a Road, the coordinates of which referred to Government Survey Tx•iangulation Station "West Base" being 668.92 South and 4,015.08 feet West and Running by azi- muths measured clockwise from Tx-ue South: 1. 187° 30' 150.00 feet along East side of Grant 6286; 2. 277° 30' 200.00 feet along remainder of said Grant 7278; 3. 7° 30' 150.00 feet along West side of Grant 6285; 4. 97° 30' 200.00 feet along North side of Hokuula Road to the Point of Beginning; Containing an area of 30,000 sq, ft. "All as outline in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the petitioner or his authorized representative submit a subdivision plan and secure ten- tative approval within one (1) year i`rom the effective date of approval of the change of zone. The petitioner/representative shall also be responsible for securing final subdivision approval; (B) a single family dwelling shall be constructed on at least one (1) of the proposed lots within three (3) years from receipt of final sub- division approval; (C) accesses to the proposed lots shall be from Hoku'ula Road: (D) the rules, regulations and requirements of the County of Hawaii Department of Water Supply shall be complied with; (E) all other applicable rules and regulations shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4 This ordinance shall take effect upon its approval.
