BE IT ORDAINED B~' THE COU]VCIL OF THE COUNTY OF HAWAII: SECTION 1. (Section '7.17 of Chapter 8 (Zoning Code), Article 2, Hawaii County Coe, as amended, is hereby further amended by adding thereto the foll~wing subsection: "7.17 ( a ). 'Phe district classification of the following area situat~d at Manowaiopae Homesteads, North Hilo, Hawaii, shall be Single F~mily Residential (RS-10): Beginning a a pipe .at the Northeast corner of this parcel of land, being also he Northwest corner of a 16.00 foot roadway on the Southerly side of Hom stead Road, the coordinates of which referred to Government Survey Tria gulation Station "MANOWAIOPAE" being 34.50 feet North and 2542.19 fee West and running by azimuths measured clockwise from true South: 1. 28° 35' 302.50 feet along remainder of Grant 8483 to Carlos Nobriga (along 16.00 foot roadway) to a pipe; 2. 47° O1' 12.65 feet along remainder of Grant 8483 to Carlos Nobriga (along roadway) to a pipe; 3. 118° 35' 63.00 feet along Lot 2 of Grant 8483 to Carlos Nobriga to a pipe; 4. 208° 35' 314.50 feet along Grant 7543 to Ruth Kauhaihao, being also Lot 19 of Manowaiopae Homesteads to a pipe; 5. 298° 35' 67.00 feet along the Southerly side of Homestead Road to the point of beginning and containing an area of 21,047 square feet. ".All as outline in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the petitioner or his authorized representative shall submit a subdivision plan and secure tentative approval within one (1) year from the effective date of the change of zone. The petitioner/represen- tative shall also be responsible for securing final subdivision approval; (B) a 10-foot wide strip along the Homestead Road be delineated and set aside for future road widening purposes; (C) a single family dwelling shall be constructed on the proposed rear lot within three (3) years of receipt of final subdivision approval; and (D) all other applicable rules and regulations shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to :its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
