HomeMy WebLinkAboutORD 1977-330 1976-1980BILL NO. 332 _ (AMENDED) COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. ~ ~n AN ORDINANCE ESTABLISHING THE NUMBER AND RATES OF COMPENSATION FOR ALL POSITIONS IN DEPARTMENTS, OFFICES AND OTHER AGENCIES OF THE COUNTY OF HAWAII UNDER THE LEGISLATIVE CONTROL OF THE COUNTY COUNCIL, DESIGNATING PAYROLL PERIODS, PAY DAYS, PRESCRIBING CERTAIN REQUIREMENTS WITH RESPECT TO OVERTIME, PERQUISITES AND OFFICIAL FIDELITY BONDS, AND REPEALING ORDINANCE 225, AND ALL AMENDMENTS THERETO; SAID ORDINANCE TO BE KNOWN AS THE SALARY ORDINANCE OF 1977. BE IT ORDAINED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Declaration of policy. It is the purpose of this ordinance to fix and establish the number and rates of compensation for all positions in departments and offices of the County of Hawaii under the legislative control of the County Council pursuant to the provisions of Section 3-14, County Charter, and chapters 76 and 77 of the Hawaii Revised Statutes. 'Phis ordinance also covers other matters relating to compensation of county employees. The term "Employees" as used in this ordinance shall include all officers. SECTION 2. Payroll periods; pay days; fractional computation. All salaries and wages shall be earned and payable in semi-monthly payroll periods, from the first (1st) to the fifteenth (15th) of each month and from the sixteenth (16th) to the end of each month; The fifteenth (15th) day and last day of each month shall be the pay days for all employees; In the case where the required service has been rendered during a full payroll period, one-half (1/2) of the monthly rate shall be paid; The Director of Finance shall be authorized to approve payroll claims covering compensation for fractional parts of a month computed otherwise than in accordance with the :Foregoing requirements, in cases where compliance with such requirements would result in hardship or unfairness to the employees involved. SECTION 3. Rate of compensation. (A) The monthly rates of compen- sation for positions c overed by th e position cl assification plan shall be based on the salary schedul~a an d wage board salary sched ule as determined and fixed i n accordance with collect ive bargaini ng Agreements and all app licable law s thereto. Employment governed by budget and appropriation. Employees to fill the positions enumerated herein are to be employed as needed and as specified in the respective applicable department budgets approved for the year, or in ordinances or resolutions supplemental there- to, to the extent that funds a.re available and appropriated by the County Council as provided by law. SECTION 5. Emergency Employment. When an emergency exists in the opinion of the Mayor, and additional labor or service, not provided for by this ordinance, is needed try the county to care for such emergency, the Mayor is authorized to appoint. to a position or employment with the county any such person or persons as he deems necessary at rates within the ranges of compensation prescribed herein, which are comparable to the rates established hereunder in view of the labor or service to be performed, - 4 - to care for such emergency; provided, however, that no person shall be so appointed unless at the time of appointment of such persons there shall be available legally expendable funds sufficient for his compensa- tion. In the event the Mayor appoints any person or persons to positions or employment under this section he shall report the same to the County Council at its next regular meeting. SECTION 6. Perquisites. That, pursuant to provisions of Section 77-16, Hawaii Revised Statutes, each department head shall determine, subject to the approval of the Mayor and under such directives as he may issue, the reasonable value of allowance rendered to employees in the form of quarters, heat, light, household equipment, and maid service, laundry service or other perquisites at the expense of the county but not for the convenience or benefit of the county and cause the reasonable value of such allowances to be deducted from the compensation of such employees. The department shall. notify the employees concerned of its findings and transmit the same t.o the Director of Personnel Services and the Director of Finance. SECTION 7. Official Fidelity Bonds. Pursuant to the provisions of Sections 62-7 to 62-9, Hawaii Revised Statutes, and any act amendatory thereto, or any provision passed in pursuance thereto by the County Council, official fidelity bonds, filed and approved in the form and manner set forth in Section 46-26 and 46-28, Hawaii Revised Statutes, shall be required of the persons appointed to or occupying certain positions enumerated in the above sections; said bonds shall be in the custody of the Director of Finance, excepting the bond of the Treasurer which shall be in the custody of the Mayor. SECTION 8. That all positions in departments and offices of the County of Hawaii under the legislative control of the County Council of the County of Hawaii be and the same are hereby fixed and established as follows: - 5 - SECTION 8.01 COUNTY COUNCIL. The repeal of the ordinance, enumerated in Section 10 above, shall not affect any act done, ratified or confirmed, or any right accruing and accrued or established, or any action, suit or proceedings had or commenced in any several cause prior to said repeal, but all rights and liability under said ordinance hereinabove repealed shall continue and may be enforced in the same manner and with the same force as if said repeal had not been made. - 30 - SECTION 12. Severability. If any section, or any part or clause of any section, of this ordinance be decided by the Courts to be unconstitu- tional or invalid, the same shall not affect the validity thereof which can be given effect without that so decided to be unconstitutional or invalid. Employment governed by budget ~adciappropriation. Employees to fill the positions enumerated hereainare to be employed as needed and as specified in the respective applic~3~e department budgets approved for the year, or in ordinances or resoYiu~ons supplemental there- to, to the extent that funds are available and .opriated by the County Council as provided by law. SECTION 5. Emergency Employment:. When an 'gency exists in the opinion of the Mayor, and additional labor or sesixce, not provided for by this ordinance, is needed by the county to c~ for such emergency, the Mayor is authorized to appoint to a position or ~doyment with the county any such person or persons as he deems necessar~ta rates within the ranges of compensation prescribed herein, which are co~r~ble to the rates established hereunder in view of the labor or sead~ce to be performed, - 4 - to care for such emergency; provided, however, that no person shall be so appointed unless at the time of appointment of such persons there shall be available legally expendable funds sufficient for his compensa- tion. In the event the Mayor appoints any person or persons to positions or employment under this section he shall report. the same to the County Council at its next regular meeting. SECTION 6. Perquisites. That, pursuant to provisions of Section 77-16, Hawaii Revised Statutes, each department head shall determine, subject to the approval of the Mayor and under such directives as he may issue, the reasonable value of allowance rer~ered to employees in the form of quarters, heat, light, household equipment, and maid service, laundry service or other perquisites at the expose of the county but not for the convenience or benefit of the county and cause the reasonable value of such allowances to be deducted from the compensation of such employees. The department shall notify the employees concerned of its findings and transmit the same to the Director of Personnel Services and the Director of Finance. SECTION 7. Official Fidelity Bonds. Pursuit to the provisions of Sections 62-7 to 62-9, Hawaii Revised Statutes, azd any act amendatory thereto, or any provision passed in pursuance th~to by the County Council, official fidelity bonds, filed and apprved in the form and manner set forth in Section 46-26 and 46-28, Hawai Revised Statutes, shall be required of the persons appointed to oroccupying certain positions enumerated in the above sections; saidbbnds shall be in the custody of the: Director of Finance, excepting thebond of the Treasurer which shall be in the custody of the Mayor. SECTION 10. Ordinance 225 and any resolutis:ramendatory thereto are hereby repealed. SECTION 11. The repeal of the ordinance, gated in Section 10 above, shall not affect any act done, ratified mnnfirmed, or any right accruing and accrued or established, or any actlia3suit or proceedings had or commenced in any several cause prior toiaiasepeal, but all rights and liability under. said ordinance hereinabovep~ee~:ed shall continue and may be enforced in the same manner and with themsaforce as if said repeal had not been made. - 30 - SECTION 12. Severability. If any section, or any part or clause of any section, of this ordinance be decided by the Courts to be unconstitu- tional or invalid, the same shall not affect the validity thereof which can be given effect without that so decided to be unconstitutional or invalid. SECTION 13. This ordinance shall be known as the Salary Ordinance of 1977 and shall take effect as of July 1, 1977.
