ORDINANCE N0. 3 ~6,
AN ORDINANCE AMENDING CHAPTER e~?OF THE HAWAII COUNTY CODE
BY ADDING A NEW ARTICFsE RELATING TO VOTER REGISTRATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2 of th.e Hawaii County Code, as
amended, is further amended by adding the following article:
"ARTICLE 6.
VOTER REGISTRATION
SECTION 1. DEFINITIONS
The following definitions shall apply to the provisions
contained in this article.
A. The term "~.andidate" shall mean an individual as
defined under Chapter 11 Part X11 (B), "Election Campaign
Contributions and Expenditures", Hawaii Revised Statutes,
as amended.
B. The term "political party" shall mean any party which
was on the ballot at the last general election and any political
group which shall hereafter undertake to form a political party
in the manner provided for in Chapter 11 Part V, "Parties",
of the Hawaii Revised Statutes, as amended.
C. The term "committee" shall mean any person as defined
under Chapter 11 Part X11 (B), "Election Campaign Contributions
and Expenditures", Hawaii Revised Statues, as amended.
D. The term "service bureau" shall mean a firm registered
to do business in the State of Hawaii and whose principal
business is furnishing data processing services.
SECTION 2. VOTER REGISTRATION COMPUTER TAPES
SECTION 2.01. LIMITATION AS TO RENTERS AND USE
The County Clerk or his designated representative may
rent voter registration computer tapes to only candidates,
political parties, committee or service bureaus, at rental
fees as hereinafter provided. The tapes shall be used only
for electioneering for public office purposes.
SECTION 2.02. RESTRICTION AS TO RELEASE OF INFORMATION
The only voter registration. information that the County
Clerk or his designated representative may release are the
name, residence address, mailing address, party ballot pre-
ference and representative district and precinct, of a voter.
SECTION 2.03. CONDITIONS OF RENT
All of the following conditions shall be met before
voter registration computer tapes may be rented:
A. The applicant obtains the written permission of
the County Clerk or his designated representative.
B. The applicant agrees in writing that he will not
use, sell or otherwise release the voter registration com-
puter tapes or the duplicate for other than electioneering
for public office purposes.
C. The candidate, political party, committee or ser-
vice bureau renting the tape agrees in writing to return
the tape in the same condition as it was prior to renting
it out, reasonable wear and tear excepted, no later than the
date specified by the County Clerk.
SECTION 2.04. CHARGES
The rental fee for the use of a voter registration
computer tape shall be fifty dollars ($50.00) for the first

seventy-two (72) hours, and thirty dollars ($30.00) per
day or a fraction thereof after the first seventy-two hours.
In addition, there shall be charges for any damage to a
voter registration computer tape.
SECTION 2.05. PENALTY
Any person who uses information found on the voter
registration computer tapes for any purpose other than
for electioneering purpose shall be guilty of a misdemeanor.
Any person convicted of a misdemeanor under this article
shall be fined not more than $1,000 or imprisoned not more
than one year, or both.~~
SECTION 3. This ordinance shall take effect upon
its approval.

A, The term "bona fide candidate" shall mean any political
candidate who has filed nomination papers for public elective
office. If political candidate has lost in the primary election,
he shall cease to be a bona fade candidate,
B. The term "political party" shall mean any party which
was on the ballot at the last general election and any political
group which shall hereafter undertake to form a political party
in the manner provided for in sections 11-62 to 11-64, Hawaii
Fevised Statutes, as amended.
C. The term "service bureau" shall mean a firm registered
to do business in the State o:E Hawaii and whose principal
business in furniohing data processing services,

The County Officer may rent voter registration computer
tapes only to bona fide candidates, political parties, or
service bureaus, at rental fees as hereinafter provided. The
tapes shall be used only for. electioneering purposes.

The only voter registration information that the County

II. The applicant agrees :in writing that he will not
sell or otherwise release the voter registration computer
tapes or the duplicate to a commercial firm, or to use or
permit the use of the tape for commercial purposes.
C. The bona fide candidate, political party or service
bureau renting the tape agrees in writing to return the tape
in the same condition as it was prior to .renting it out,
reasonable wear and tear excepted, nn later than the date
specified by the County Clerlc.
SECTION 2.04. CHARGES

This Bill amends Chapter 2 of the Hawaii County Code by
adding a new article relating to Voter Registration.
