HomeMy WebLinkAboutORD 1978-355 1976-1980BILL NO. 3B2 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE No. 355 AN ORDINANCE AMENDING SECTION 7.04, THE KAILUA URBAN ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM RESORT-HOTEL (V-1.25) TO VILLAGE COMMERCIAL (CV-7.5) AT HIENALOLI 4TH, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-08:21. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.04 of Chapter 8 (7.oning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.04( n ). The district classification of the following area situated at Hienaloli 4th, North Kona, Hawaii, shall be Village Commercial (CV-7.5) Beginning at a pipe in concrete at the Northwest corner of this parcel of land, on the East side of Kuakini Highway (Federal Aid Project 5229 (1), and on the South boundary of L. C. Aw. 7716, Apana 5, the coordinates of point of beginning referred to Govern- ment Survey Triangulation Station "NORTH MERIDIAN" being 2043.28 feet South and 1601.94 feet East, thence running by azimuths measured clockwise from True South:: 1. 266° 25' 63.3() feet along stone wall, along L. C;. Aw. 7716, Apana 5, to a pipe in concrete; 2. 258° 40' 105.11 feet along same to a pipe in concrete; 3. 263° 34' 71.2!i feet along same to a pipe in concrete; 4. 267° 38' 183.9? feet along same to a pipe in concrete; 5. 324° 16' 30" 99.7:1 feet along the West side of the Hualalai Road, to a pipe in concrete; 6. 69° 54' 30" 407.65 feet along L. C. Aw. 8524-B to a pipe in concrete; 7. 151° 59' 204.80 feet along the East side of Kuakini Highway (Federal Aid Project 5229 (1) to the point of beginning, and containing an area of 1.41 acres, or thereabouts. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forth- with upon the conditions that (A) only one (1) access, which may include a single common access, be allowed from Kuakini Highway; (B) the rules, regulations, and requirements of the Department of water Supply be com- plied with; (C) plans for one of the proposed structures shall be sub- mitted for Plan Approval within one (1) year from the effective date of approval of the Change of Zone; (D) construction of one (1) of the pro- posed structures commence within one (1) year from the date of receipt of Final Plan Approval and be completed within two (2) years thereafter; (E) the method of sewage disposal meet with the rules, regulations, and requirements of the State Department of Health; (F) should any archaeo- logical or historical sites be found during land preparation or grading, the Planning Department shall be immediately notified. Such sites shall not be disturbed until authorization from the Planning Department is received; and (G) all other applicable rules and regulations, be complied with. Should any of the foregoing conditions not be met, rezon- ing of the area to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4 This ordinance shall take effect upon its approval.
