HomeMy WebLinkAboutORD 1978-356 1976-1980BILL No. 3$3 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE No. 356 AN ORDINANCE AMENDING SECTION 7.04, THE KAILUA URBAN ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM MULTIPLE FAMILY RESIDENTIAL (RM-1) TO VILLAGE COMMERCIAL (CV-7.5) AT KEOPU 3RD, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-22:24. BE IT ORDAINED BY THE COUNCIL OF THF. COUNTY OF HAWAII: SECTION 1. Section 7.04 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.04( o ). The district classification of the following area situated at Keopu 3rd, North Kona, Hawaii, shall be Village Commercial (CV-7.5): Beginning at the point of curve on the Northeast corner of this parcel of land on the Southwesterly side of Kalawa Street, the coordinates of which referred to Government Survey Triangulation Station "KAILUA" being 657.82 feet South and 1234.21 feet East and running by azimuths measured clockwise from True South: Thence, following along the Northwesterly side of Kalani Street on a curve to the right with a radius of 20.00 feet, the chord azimuth and distance being: 1. 9° 27' 29.90 feet; 2. 57° 50' 98.33 feet along the Northwesterly side of Kalani Street; 3. 141° 04' 122.50 feet along the remainder of Royal Patent 4475, Land Commi~- sion Award 7713, Apana 5 to V. Kamamalu along Lots 46 and'45 of the Lono Kona Subdivision;', 4 231° 04' 120..00 feet along the remainder of . Royal Patent 4475, Land Commi~- sion Award 7713, Apana 5 to V. Kamamalu along Lot 65 of the Lono Kona Subdivision; 5. 321° 04' 114.23 feet along the Southwesterly side of Kalawa Street to the point of beginning and contain- ing an area of 15,417 square feet. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the additional parking area shall be provided within one (1) year from the effective date of approval of the change of zone, and shall be constructed with all-weathered, dust-free surface; (B) prior to construction, the petitioner shall confer with the Depart- ment of Public Works as to the necessity of providing drainage sumps; and (C) all other applicable rules and regulations, including the Plan Approval process, shall be complied with. Should any of the foregoing conditions not be met, rezoning of the property to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
