ORDINANCE N0. - `~6'~ AN ORDINANCE AMENDING SECTION 7.03 THE SOUTH KONA ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-Sa) TO AGRICULTURAL (A-3a) AT KEEI 2ND, SOUTH KONA, HAWAII, COVERED BY TAX MAP KEY 8-3-10:3. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.03 of CDhapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.03 ( u ). The district classification of the folllowing area situated at Keei 2nd, South Kona, Hawaii, shall be Agric~hltural (A-3a): Beginning at a pipe at the Northeast corner of this Parcel and on the East side of Keei Middle Road, the coordinates of point of beginning referred to Government Triangulation Station "LAE O KANONI" being 5,222.5 feet North and 12,324.0 feet East, thence running by azimuths measured clockwise from true South: 1. Along the West side of Keei Middle Road on a 409.3 foot radius curve to the left, the azimuth and distance of the chord being 334° 10' 111.10 feet, 2. 326° 22' 76.31 feet along the West side of Keei Middle Road, 3. Along the West side of Keei Middle Road on a 293.3 foot radius curve to the right, the azimuth and distance of the chord being 343° 35' 173.63 feet, 4. Oo 48' 63.56 feet along the West side of Keei Middle Road, 5. Along the West side of Keei Middle Road on a 191.6 foot radius curve to the left, the azimuth and distance of the chord being 357° 13' 23.95 feet to a pipe, 6. 82° 14' 1577.96 feet along the property belonging to Tamakichi Kamigaki, to a pipe in stonewall, 7. 180° 50' 488.22 feet along stonewall, along the B. P. Bishop Estate property, to a pipe, 8. 264° 15' 1423.52 feet along Parcel 2 to the point of beginning. Area Contained Within 16.0 Acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the petitioner or his authorized representative submit a subdivision plan and secure tentative approval within one (1) year from the effective date of the adoption of the change o£ zone. The petitioner/representative shall also be responsible for securing final subdivision approval; (B) the rules, regulations, and requirements of the Department of Water Supply shall be complied with; and (C) all other applicable rules and regulations be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
