AN ORDINANCE APIENDING SECTION 7.29 'PHE CITY OF HILO ZONE T~fAP OF
CHAPTER 8 (ZONING CODE), ARTICLE 2, HAb^JF,II COUNTY CODE, AS AMENDED,
BY CHANGING THE DISTRICT CLASSIFICA'PION FROM AGRICULTURAL (A-la)
TO SINGLE FAMILY RESIDEPITIAL (RS-10) 1,T 4^7AIAKEA, SOUTH HILL, HAl^1AII,
COVERED BY TAX MAP YEY 2-4-4'2:58, 5'4 & PORTION OF 78.
BE IT ORDAIN']D BY THE COUNCIL OF THE CUUNTY OF HALdAII:
SECTION 1. Section 7.29 of Chapter 8 (:Zoning Code), Article 2,
Haoaaii County Code, as amended, is hereb~;~ further amended ky adding
thereto the folloo!inq subsection:
"7.?9 (eee). The district classification of the folloiaing
area situated at [4aiakea, South Hilo, Hawaii, shall be
Single Fami7.~~ Y.esidential (RS-10):
Begi_rni_ng at the Northeast corner of this parcel of lewd,
being also the Southeast corner of Grant 11,634 to Yoshio and
Hirol:o I. Tomori and the Southeast corner of Lot 70, Kuulei
Subdivision, Unit I (File Plan 1511) and on the westerly
boundary of Grant 11,4].8 to James T9. IvicSwanson, the coordinates
of said point °f beainninq referred to Government Surti^ey
Triangulation Station "HP.LAI" being 14,049.27 feet South and
15?5.77 feet East, thence running by azimuths measured clockwise
from True South:

SECTION 2. Section 1 of this ordinance shall take effect
forthwith upon the conditions that (A) the petitioner or his authorized
representative submit a subdivision plan and ser_urF tentative approval
within one (19 year From the effect'i.ve date of approval of the
change of zone. The petitioner/represer,tati~re shall also be
responsible for securing final subdivision approval- (B) a minimum
of twenty-five percent (25~) of the total number of single family-
dwellings proposed for the entire area shall be constructed within
five (5) years from the effective date gf final subdivision approval;
(C) a hydrologic/drainage study be prepared b~;~ the petitioner and
be submitted with the subdivision p:Lans to the Planning Director and
the Chief )ingineer of the Department of Public 64orks; and (D) all
other applicable rules, regulations, anc requirements shall be
complied with. Should any of the foregoing r_onditions not be met,
rezoning of the area to its original zoning designation mad; be
initiated.
f;tiCTION 3. In the event that any portion of this ordinance
i.s declared invalid, such invalidity shall not affect the ether
parts of this ordinance.
SECTION ~!-. This ordinance shawl take effect upon its approval.
