HomeMy WebLinkAboutORD 1978-372 1976-1980BILL NO. 4G4 COUNTY OF HAWAII - STA7.'E OF HAWAII ORDINANCE NO. ~ % ti AN ORDINANCE AMENDING SECTION 7.29 THE CITY OF HILO ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-7.5) TO OPEN (O) AT PONAHAWAI, SOU7.'H HILO, HAWAII, COVERED BY TAX MAP KEY 2-3-20:PORTIONS OF 2 & 7. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.20 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.29 (gc~. The district classification of the following area situated at Ponahawai, South Hilo, Hawaii, shall be Open (0): Beginning at the northern corner of.` this parcel of land, being the east corner of Parcel C and on the southwesterly side of Lot 1-A of Ld. Ct. App. 1749 (Map 3), the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAL" being 706.32 feet North and 1,518.79 feet East thence running by azimuths measured clockwise from True South: 0 1. 325 53' 320.49 feet along Lot 1-A of Ld. Ct. App. 1749 (Map 3); 0 2. 54 38' 10" 1,093.55 feet along Lot C-3 and Lot C-2, portions of Grant 252 to B. Pitman; 0 3. 153 35' 248.70 feet along Lot C-1, a portion of Grant 252 to B. Pitman; 0 4. 156 39' 20.00 feet along the east side of Amakihi Street; 0 5. 231 39' 1,059.12 feet along the southeasterly sides Parcels A and C to the point of beginning and containing an area of 7.218 Acres. "All as outlined in red on tYie map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the petitioner shall comply with the rules and regulations as outlined in Chapter 4, Article 1 (Relating to Cemeteries) of the Hawaii County Code within one (].) year from the effective date of the change of zone; (B) the petitioner- or its authorized representative shall file a subdivision plan for Phase I of the development and receive tentative approval within one (1) year after compliance with the requirements as spelled out in Condition Number 1. The petitioner/representative shall also be responsible to secure final subdivison approval; (C) prior to construction of any structures, including areas for parking, the petitioner shall submit such plans to the Planning Department for review and approval; (D) the rules, regulations, and requirements of the State Department of Health shall be complied with; and (E) all other applicable rules and regulations be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity sha1:L not affect the other parts of this ordinance. SECTION 4. This ordinance shall i:ake effect upon its approval.
