ORDINANCE NO. ~~3
AN ORDINANCE AMENDING SECTION 7.05 THE KAILUA-HONALO URBAN ZONE MAP
OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED,
BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL
(RS-15) TO VILLAGE COMMERCIAL (CV-7.5) AT KAWANUI 2ND, NORTH KONA, HAWAII,
COVERED BY TAX MAP KEY 7-9-08:26.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.05 of Chapter 8 (Zoning Code), Article 2,
Hawaii County Code, as amended, is hereby further amended by adding
thereto the following subsection:
"7.05 ( t ). The district classification of the following
area situated at Kawanui 2nd, North Kona, Hawaii, shall be
Village Commercial (CV-7.5):
Beginning at a spike in wall at the northeast corner of this
parcel of land, at the southeast corner of Grant 1178 to
Hapuku and on the west side of Mamalahoa Highway, the coordinates
of said point of beginning referred to Government Survey
Triangulation Station "PUU 0 HAU" being 10100.25 feet north
and 8340.69 feet east, and running by azimuths measured clockwise
from true south:
0
1. 349 24' 136.10 feet along the west side of Mamalohoa
Highway to a spike;
0
2. 69 31' 115.22 feet along the north side of a 10-foot
road easement to a spike;
0
3. 78 25' 163.70 feet along same to a pipe at stonewall
intersection;
0
4. 168 55' 30" 98.17 feet along middle of stonewall to a pipe;
0
5. 161 50' 59.72 feet along same to a pipe at stonewall
intersection;
0
6. 259 08' 285.87 feet along middle of stonewall along
the south side of Grant 1178 to
Hapuku to the poin t of beginning
and containing an area of 42,458
square feet.
"All as outlined in red on the map attached hereto,
marked Exhibit 'A' and by reference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect forthwith
upon the conditions that (A) prior to establishment of the proposed
uses, the petitioner or his authorized representative shall submit
plans to the Planning Department for "Plan Approval." Such plans shall
be submitted within one (1) year from the effective date of the change
of zone. The proposed uses shall be established within one (1) year
of receipt of final Plan Approval; (B) the rules, regulations, and
requirements of the State Department of Health and the County Department
of Water Supply shall be complied with; (C) the driveway to and
parking area for the proposed use be paved with all-weather, dust-free
surface. The width of the pavement and the number of parking stalls
shall be determined at the time of Plan Approval. No direct access
from the parking stalls onto the main highway will be allowed; and
(D) all other applicable rules and regulations shall be complied with.
Should any of the foregoing conditions not be met, rezoning of the
area to its original zoning designation may be initiated.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of
this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
