BE IT ORDAINED BY THE COU?VC II. OP' THF: COUNTY OE' 1LIWAII:
SECTION 1. Section 7.05 of Chapter 8 (Zoning Code), Article 2,
Hawaii County Code, as amended, is hereby further amended by auding
thereto the following subsection:
"7.05 ( u ). 'fhe district classification of the following
area situated at Kawanui 1st, iVorth Kona, Ilawaii, shall be
Single Family Residential (RS-10):
Beginning at a point on the southerly boundary of ti~is parcel of
land, the coordinates of which referred to Government Survey
Triangulation Station "PUU OHAU" being 10,704.58 feet North and
8,842.46 feet East and running by azimuths measured clockwise
from true South:
1. 84° 38' 163.37 feet along the northerly side of
an existing road;
2. 163° 54' 226.31 feet along Lot B-5, along remainder
of Grant 987 to Pololi;
3. 253° 54' 290.56 feet along Lot 1, along remainder of
Grant 987 to Pololi;
4. 344° 02' 30" 168.23 feet along stonewall, along remainder
of Grant 987 to Pololi;
Thence along the northwesterly side of an existing road for the
following five (5) courses:
5. 311° O1' 30" 7.65 feet;
6. 30° 32' 30"
7. 39° 48' 3U"
8. 57° 11'
9. 84° 38'
82.22 feet;
38.91 feet;
25.04 feet;
18.12 feet
to the point of beginning and
containing an area of 1.578 Acres.
"All as outlined in red on the map attached hereto, marked
Exhibit 'A' and by reference made apart hereof."
SECTIUN 2. Section 1 of this ordinance shall take effect forthwith
upon the conditions that (A) the petitioner or its authorized represen-
tative shall submit a subdivision plan and secure tentative approval
within one (1) year from the effective date of approval of the ~~hange of
zone. The petitioner/representative shall also be responsible :for
securing final subdivision approval; (ll) a single-family dwelling shall
be constructed on at least one (1) of the proposed lots within three (3)
years from the date of receipt of final subdivision approval; (~") the
rules, regulations, and requirements of the Department of ;ti~ater Supply
shall be complied with; and (D) all other applicable rules and regulations
shall be complied with. Should any of the foregoing conditions not be met,
rezoning of the area to its original zoning designation may be initiated.
SECTION' 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of this
ordinance.
SECTIUN 4. This ordinance shall take effect upon its approval.
