HomeMy WebLinkAboutORD 1978-375 1976-1980BILL NO. hO$ COUNTY OF HAWAI] - STATE OF HAWAII ORDINANCE NO. c7~S AN ORDINANCE AMENDING SECTION 7.29 THE CITY OF HILO ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE D]STRICT CLASSIFICATION FROM OPEN (O) TO SINGLE FAMILY RESIDENTIFS, (RS--15) AT WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2--4-19:PORTION OF 27. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.29(hhh). The district classification of the following area situated at Waiak.ea, South Hilo, Hawaii, shall be Single Family Residential (RE-15): Beginning at the southeast corner of this parcel of land, being also the southeast corner of Land Patent Grant 5-15439 to Hawaii Hou:;ing Authority, the southwest corner of Grant 11114 to Hayako Matsui, the northwest corner of Grant 9781 to Asako Nishimura and the northeast corner of Grant 11566 to Justin M, de Mello, the coordinates of said point of beginning rei`erred to Government Survey Triangulation Station "HALAI" being 13,792.54 feet South and 4,944.21 feet East, thence running key azimuths measured clockwise from True South: 0 1. 85 40' 4E~3.04 feet along Grant 11566 to Justin M. de Mello; 0 2. 175 38' 3E~7.45 feet along Grant 11445 to Moses M. Ahuna; 0 3. 265 40' 4E~3.27 feet along remainder of Land Patent Grant 5-15439 to Hawaii Housing Authority 0 4. 355 40' 3E17.45 feet along Grant 11114 to Hayako Matsui to the point of beginning and containing an area of 4.298 Acres "All as outlined in reci on the map attached hereto, marked Exhibit 'A' and by re~`.erence made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forth- with upon the conditions t}>at (A) the petitioner or its authorized representative submit a su}~division plan for the area and secure tentative approval within one (1) year from the effective date of approval of the zone changes. The petitioner/representative shall also be responsible for securing final subdivision approval; (B) a minimum of twenty-five pesrcent (25~) of the total number of single family dwellings proposed for the subject area shall be constructed within five (5) years from the effective date of final subdivision approval; (C) a hydrologic/drainage study shall be submitted at the time of subdivision re~~iew; and (D) all other applicable rules and regulations shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original or a more appropriate zoning de::ignation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such inv~lidit}~ shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
