Section 1 of this; ordinance shall take effect forthwith upon the conditions that (A) the overal:L development shall conform sub- stantially to the plans submitted and the representations made by the -50- petitioner. Said plans shall be on file at the Planning Department and shall consist of "File Exhibit 2" which is the accepted Enviror..mental Impact Statement and "File Exhibit: 3" which is the revised development plan; (B) the total number of hoteal units shall not exceed 3,000 rooms. Development of the resort zoned d:stricts shall occur in three increments, each of which shall not exceed 1,000 hotel rooms. The effective date of zoning for the second and third increments shall be after development has occurred in the previous incremen'_. Development is defined as building permits issued for an operational hotel and twenty-five (25) percent com- pletion of the number of hotel units allowed in the previous increment; (C) development of the Multiple Family Residential (RM) zoned districts shall occur in ten (10) increments. Each of the first nine (9) increments shall not exceed 300 units. The effective date of zoning for a~ubsequent increments shall be after development has occurred in the previous incre- ment. Development is defined as :wilding permits issued for t}re multiple family residential units and construction partially completed :_n the sense of having roofs on a minimum of fifteen (15) percent of the un.~ts in the previous increment; (D) the petitioner shall submit a plan for the develop- ment of a resort commercial shopping area within the Village Commercial (CV) zoned district prior to the effective date of zone for the second resort and/or third multiple family residential zoning increme~its, which- ever is sooner; provided, however, that. the Planning Director, upon con- sultation with the Director of Research. and Development and up~~n the petitioner's submittal of a market feasibility study which demonstrates a low commercial demand for the CV zoned area even after the effective date of zoning for the second resort and/or third multiple family residen- tial zoning increment, may extend the commence construction date; (E) the petitioner shall submit a subdivision plan and secure tentative subdivision approval for the first hotel site, the golf course clubhouse site, the -`_il- historic preserves, public park, service area and the first multiple family residential site within one'. year from the effective date of appro- val of the change of zone request. The petitioner shall also be responsible for securing final subdivision approval;; (F) the method of sewage disposal shall conform to the rules and reculations of the State Departrent of Health; (G) prior to the development of e«ch increment, water shall be made avail- able in compliance with the rules, regulations and requirements of the Department of Water Supply; (H) a minimum of 53 acres of land shall be set aside for park and recreational purposes for the petitioner's total pro- posed development encompassing 3,x:00 acres. The actual amount of these recreational lands to be incorporzcted within the 771.5-acre area covered by this rezoning action shall be determined by the Planning Director as the development progresses. A minimum of 3.2 acres of this area shall be developed concurrently with the first Multiple Family Residential increment. The general location of this park shall be in the area designated on File Exhibit 3; however, the exact locution shall be determined at the time of subdivision approval of the first increment. Minimum improvements of the 3.2-acre area shall include but not be limited to grading and grassing which meet the approval of the Parks and Recreation Director. This park area shall remain in pr=_vate ownership and maintenance until such time that the petitioner decades to dedicate the area to «nd it is accepted by the County. There shall also be adequate assur~ince, as determined by the Corporation <:ounsel, for the maintenance cif the private park by recorded covenant running with the land; (I) ttce peti- tioner shall set aside three (3) Historic sites preserved, tot~clling approximately 23.6 acres, as desi<~nated in File Exhibit 3 and :subject to the approval of the Planning Director. The petitioner shay. submit plans for the historic preserves ~o the Planning Director for ~~eview and approval prior to undertaking any research, restoration, reconstruction, or development within the histori~~ preserves. Such plans shal_~ include a - 52 - -., ~, - - 55 - proposed management and interpretation program and the means of providing public access to the historic preserves. Further, any alteration and/or salvage of archaeological sites recommended to be salvaged in Fishop Museum Manuscript Number 081275 on file _n the Planning Department shall first be approved by the Planning Director. The petitioner shall also :•ubmit to the Planning Department plans for inteerim control and protection measures for sites which are not to be immediai:ely salvaged, researched, or developed within one (1) year of the effective date of approval of the cY.ange of zone; (J) the King's, or Mamalahoa, Trail sha:11 be open for public access. Any breaching of this Trail shall fir:;t be approved by the Planninc Director. The number of breaches in the Trail shall be limited to three 13). The petitioner shall also provide public access to the fishponds meeting with the apL~roval of the Planning Director; (L) the petitioner shall provide a minimuri of three (3) public accesses: to the shoreline. Public parking areas pit the mauka end of each access shall be provided. Such public access sha]_1 be provided in perpetuity e.nd by recorded covenant running with thEe land. The petitioner shall submit plans for the general locations oi: such public accesses and parking areas to the Planning Director for reviE:w and approval within one (1) year from the effective date of approval of the change of zone; (M) accee;s shall be off of the Queen Ka'ahumanu Highway. The access road shall coT~sist of a 120-foot right-of-way with a 24-foot wide pavement up to Inter:;ection "Z" as designated on File Exhibit 3 oii file with the Planning Department. The petitioner shall also provide a cliannelized intersection, meeting the approval of the State Department cif Transportation, Land TransL~ortation Facilities Division, and the Chie_' Engineer, County Department of Public -53- approval; (Q) the petitioner shall provide temporary quarters Eor the construction workers on the proposed 2.7+ acre Multiple Family Residential parcel adjacent to the Limited Industrial zoned district. The channelized intersection shall be constructed concurrently with i.he first resort increment; (N} construc- tion of the golf course shall comrlence within one (1) year from the effec- tive date of approval of the chancke of zone request and shall k~e completed within three years from the comme~rcement of construction. The plans for the golf course shall be submitted to the Planning Department i.'or review and approval. The golf course cl~xbhouse facility shall be comi~leted and be in operation with the opening cif the golf course; (0) any golf cart and/or golf course maintenance vehicle crossing of public thoroughfares shall be in compliance with Artic:Le 5, Chapter 6 (Traffic Code;, of the Hawaii County Code, as amended; (]?) the petitioner shall provide a minimum of twenty-eight (28) units for the purpose of resort employee kiousing for the first 350 hotel rooms prior to the issuance of the occupancy permit for the first operational hotel. The manner in which these un=.ts are to be provided shall meet the approval of the Planning Director. Resort employee housing requirements for subsequent hotel development shall be based upon additional housing need studies prepared by the petitioner and shall be determined at the time o~ full Planned Unit Development (PUD) approval; (Q) the petitioner sha1L provide temporary quarters ±`or the construction workers on the proposed 2.7+ acre Multiple Family Residential parcel adjacent to the Limited Industrial zoned district. Suc}r housing may be converted to resort employe housing at a later date, subject to the approval of the Planning Dire~~tor; (R) the petitioner shalt. submit an annual progress report to the Planning Director within thirty ;30) days of the anniversary of the effective date of the change of zone reckuest. The annual report shall include but n~~t be limited to a listing of the work completed and in progress, the mariner in which the stipulated conditions of approval of the change of zone request are being met, the amount of direct employment generated, any •;programs initiated which relai:e directly to the overall development, and a:iy additional information which would -54- supplement and/or alter the conclusions arrived at in the environmental impact statement identified as File Exhibit 2; (S) the petitioners reserve a minimum area of ten (10) usable acres for a future school sits. The location of the school site shall meet with the approval of the Department of Education and the Planning Director; (T) the petitioner shall submit an overall landscaping plan which includes the use of native anfl indigenous plants for the first resort increment to the Planning Director Eor review and approval within one year from the effective date of approval; (U) all major utility lines within the development area shall be installed under- ground. Temporary overhead lines may be: permitted subject to the approval of the Planning Director; and (V) all other applicable rules ani regulations, including the Plan Approval process, and conditions of approval of other permits shall be complied with. SECTION 3. Should any of the conditions in Section 2 not oe met, rezoning of the subject area to its original or more appropriate zoning designations may be initiated. SECTION 4. Ordinance No. 203 adopted on April 19, 1976, is hereby repealed in its entirety. SECTION 5. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 6. This ordinance shall take effect upon its approval.
