PAYROLL PERIODS, PAS.' DAYS, PRESCRIB:LidG CERTAIN REQUIREMENTS WITH RESPECT
TO OVERTIA9E, PERQUISITES AND OFFICIi~L FIDELITY BONDS, AND REPEALING
ORDINANCE 330, AND ALL A:IENDMENTS THERETO; SAID ORDINANCE TO BE KNOWN
AS THE SALARY ORDINANCE OF 197$.
BE IT ORDP.INED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Declaration of policy. It is the purpose of this
ordinance to fix and establish the :number and rates of compensation
for all positions in departments and offices of the County of Hawaii
under the legislative control of th~a County Council pursuant to the
provisions of Section 3-14, County ~harter, and chapters 76 and 77 of
the Hawaii Revised Statutes. This ordinance also covers other matters
relating to compensation of county employees. The term "Employees" as
used in this ordinance shall include all officers.
SECTIOP7 2. Payroll periods; pay days; fractional computation. All
salaries and wages shall be earned and payable in semi-monthly payroll
periods, from the first (1st) to the fifteenth (15th) of each month
and from the sixteenth (16th) to the end of each month;
The fifteenth (15th) day and last day of each month shall be the
pay days for all employees;
In the case where the required service has been rendered during a
full payroll period, one-half (1/2) of the monthly rate shall be paid;
The Director of Finance shall be authorized to approve payi~oil
claims covering compensation for fractional parts of a month coriputed
otherwise than in accordance with the foregoing requirements, ir: cases
where compliance with such requirements would result in hardship or
unfairness to the employees involved.
SECTION 3. Rate of compensation. (A) The monthly rates of compen-
sation for positions covered by the position classification plan shall
be based on the salary schedule and wage board salary schedule as
determined and fixed in accordance with collective bargaining Agreements
and all applicable laws thereto. (B) Employees occupying positions not
subject to the compensation schedule set forth in subparagraph (A) here-
inabove shall be paid at rates of compensation as fixed and established
by applicable provisions of the Hawaii Revised Statutes and any act
amendatory thereto, or any resolution in pursuance thereof by the County
Council in accordance with the following schedule:

(D) The Mayor and the Council shall review and compensate officers and
exempt employees at an appropriate step within a salary range an the same
basis as employees of bargaining un its; provided, however, review and
compensation shall be based on assu ring a sensible relatio nship and
attracting and retaining competent persons for county service, establish-
ing and maintaining a high level oi` efficiency of such persons and adequately
compensate them for the work they do.

SECTION 4. Employment governed by budget and appropriation.
Employees to fill the positions enumerated herein are to be employed as
needed and as specified in the resF~ective applicable department budgets
approved for the year, or in ordine:nces or resolutions supplemental there-
to, to the extent that funds are available and appropriated by the County
Council as provided by law.
SECTION 5. Emergency Employment. When an emergency exists in the
opinion of the Mayor, and additional labor or service, not provided for
by this ordinance, is needed by the county to care for such emergency, the
Mayor is authorized to appoint to ~~ position or employment with the county
any such person or persons as he d~:ems necessary at rates within the ranges
of compensation prescribed herein, which are comparable to the rates
established hereunder in view of t;Ze labor or service to be performed,

to care for such emergency; providE:d, however, that no person skull be
so appointed unless at the time of appointment of such persons there
shall be available legally expendak~le funds sufficient for his compensa-
tion. In the event the Mayor appoints any person or persons to positions
or employment under this section he: shall report the same to thc: County
Council at its next regular meetinct.
SECTION 6. Perquisites. That:, pursuant to provisions of Section
77-16, Hawaii Revised Statutes, each department head shall determine,
subject to the approval of the Mayor and under such directives :is he
may issue, the reasonable value of allowance rendered to employees in
the form of quarters, heat, light, household equipment, and maick service,
laundry service or other perquisites at the expense of the county but not
for the convenience or benefit of t:he county and cause the reasonable
value of such allowances to be deducted from the compensation of such
employees. The department shall notify the employees concerned of its
findings and transmit the same to t:he Director of Personnel Services and
the Director of Finance.
SECTION 7. Official Fidelity Bonds. Pursuant to the provisions of
Sections 62-7 to 62-9, Hawaii Revi:;ed Statutes, and any act amendatory
thereto, or any provision passed iii pursuance thereto by the County
Council, official fidelity bonds, riled and approved in the form and
manner set forth in Section 46-26 rind 46-28, Hawaii Revised Statutes,
shall be required of the persons appointed to or occupying certain
positions enumerated in the above ;sections; said bonds shall be in the
custody of the Director of Finance, excepting the bond of the Treasurer
which shall be in the custody of tJze Mayor.
SECTION 8. That all positions in departments and offices of the
County of Hawaii under the legislative control of the County Council of
the County of Hawaii be and the same are hereby fixed and established
as follows:

SECTION 9. The positions and rates of compensation adopted in the
1978 budget of the County of Hawaii are trereby ratified and confirmed
as of July 1, 1978; and that any cxeatiori, reallocation of positions,
salary range reassignment or other changes of pay subsequent to the
adoption of said budget, shall take effect as authorized on the date of
such creation, reallocation, salary range: reassignment or change of pay
or a date otherwise prescribed, subject t:o the certification of avail-
ability of funds by the Director of Finance. All incremental pay increases
effective July 1, 1978, and granted pursciant to collective bargaining
agreements are hereby ratified and confirmed as of July 1, 1978.
SECTION 10. Ordinance 330 and any resolutions amendatory thereto
are hereby repealed.
SECTION 11. The repeal of the ordinance, enumerated in Section 10
above, shall not affect any act done, ratified or confirmed, or xny right
accruing and accrued or established, or any action, suit or proc=_edings
had or commenced in any several cause prior to said repeal, but x11 rights
and liability under said ordinance herein~above repealed shall continue and
may be enforced in the same manner and with the same force as if said repeal
had not been made.
SECTION 12. Severability. If any section, or any part or ,:lause of
any section, of this ordinance be decided by the Courts to be un~onstitu-
tional or invalid, the same shall not affect the validity thereof which
can be given effect without that so decided to be unconstitution.xl or
invalid.
SECTION 13. This ordinance shall be known as the Salary Ordinance of
1978 and shall take effect as of July 1, 1978.
