HomeMy WebLinkAboutORD 1978-382 1976-1980BILL NO. 413 COUNTY OF HAWP.II - STATE OF HAWAII ORDINAICE NO. _ 38~' AN ORDINANCE AMENDING SECTION 7.20, THE KURTISTOWN ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII CC~UNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-20) TO NEIGHBOR- HOOD COMMERCIAL (CN-10) AT OLAA, Pi NA, HAWAII, COVERED BY TAX MAP KEY 1-7-19:PORTION OF 25. BE IT ORDAINED BY THE COUNCIL OF TFE COUtdTY OF HAWAII: SECTION 1. Section 7.20 of Ck.apter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.20(e). The district classification of the following area situated at Olaa, Puna, Hawaii., sha:Ll be Neighborhood Commercial (CN-10): Beginning at a 1/2-inch pipe i.n concrete at the West corner of this parcel of land, on the East side of Volcano Road, the coorcinates of said point of beginning rei'erred to Government Survey Triangula- tion Station "OLAA" being 2020.32 feet South and 372.87 feet West, and running by azimuths measured clockwise from True South: 1. 191° 50' 95.4'8 feet along the East side of Volcano Road to 1/2-inch pipe in concrete; 2. 212° 46' 8.25 feet along same; 3. 297° 49' 251.94 feet along the remain~er of Grant 7583, being also along Lot 2-A to 1/2-inch pipe in concrete; 4. 27° 49' 100.00 feet along the remainder of Grant 7583, being also along Lot 15 to 1/2-inch piF~e in concrete; 5,. 117° 49' 226.37 feet along the remainder of Grant 7583, being also along Lot 1, to the point oi' begin- ning and containing aii area of 24,056 square feet.. "All as outlined in red ~~n the map attached hereto, mzcrked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the petitioner or his authorized representa- tive shall submit plans to the Planning Department for Plan Approval within one (1) year from the effective date of approval of the change of zone; (B) the petitioner shall occLpy the building for its intended use within one (1) year after receipt of final Plan Approval; (C) the rules, regulations, and requirements of tY,e State Departments of Health and Transportation, Land Transportation Faci:Lities Division, shall re complied with; and (D) all other applicable rules and regulations shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original zoning design~:tion may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity :>hall not affect the other pants of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
