ORDINANCE NO. 385
AN ORDINANCE AMENDING ORDINANCE NO. 15 RELATING TO A CHANGE OF
DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-3a) TO AGRICUL'CURAL
(A-la) IN WAIAKEA HOMESTEADS, '4AIAKEA, SOUTH HILO, HAWAII, COVERED
BY TAX MAP KEY 2-4-04:30.
BE IT ORDAINED BY THE COUNCIL JF THE COUNTY OF HAWAII:
SECTION 1. Section 2, Ordinance 15, is hereby amended so
as to read in its entirety as Follows:
"Section 2. Section 1 of this ordinance shall ta;ce
effect forthwith upon the conditions that (A) the applicant,
Hirosuke Akamine, submit and secure tentative approval of
the proposed subdivision within. one (1) year of the da.e
of approval of the change of zone; (B) one (1) dwellin~3
be constructed on the resultant. lots within one (1) year
of the date of final subdivision approval; and (C) a 5)-
foot right-of-way, which would be a continuation of Ak.~a
Street, be set aside through the width of the proposed
subdivision. Should any of the foregoing conditions mgt
be met, rezoning of the area tc its original or a more
appropriate zoning designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance sha].1 take effect upon its approval.
