AN ORDINANCE AMENDING SECTION 7.15, THE NORTH HILO DISTRICT ZOI7E MAP OF
CHAPTER 8 (ZONING CODED, ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY
CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO AGRI-
CULTURAL (A-la) AT WAIKAUMALU-MAULUA, NORTH HILO, HAWAII, COVERED BY
TAX MAP KEY 3-2-02:PORTZON OF 41.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.15 of Chapter 8 (Zoning Code), Article 2,
Hawaii County Code, as amended, is hereby further amended by adding
thereto the following subsection:
"7.15(d). 7'he district classification of the following area
situated at t^7aikaumalu-Maulua, North Hilo, Hawaii, shall lie
Agricultural (A-].a):
Beginning at a point at the north corner of this parcel o.- land and
on the southwesterly side of Hawaii Belt Road (F.A.P. SDR 3(3)), the
coordinates of send point of beginning referred to Government Survey
Triangulation Station "HAIKU" being 2385.52 feet North anti 1900.86
feet East and running by azimuths measured clockwise from true South:
1. 317° 40' 30" 118.85 feet along the southwesterly
side of Hawaii Belt Road
(F.A.P. SDR 3(3));
2. 41° 00' 45.56 feet along remainder of Lot 3,
Grant 4719 to J. R, Cadinha;
3. 33° 12' 298.94 feet along Lot 3B remainder of
Grant 4719 to J. R. Cadinha;
4. 165° 22' 200.37 feet along Easement B (30-Feet
Wide), within Lot 3B, remainder
of Grant 4719 to J. R. Cadinha;
thence along Easement C (30-Feet
Wide), within Lot 3B, remainder
of Grant 4719 to J. 4. Cadinha
along a curve to the left having
a radius of 315.00 faet, the
chord azimuth and distance being:
5. 183° 10' 11" 35.20 feet;
6. 179° 58' 18.06 feet along Easement ~ (30-Feet
Wide), within Lot 3B, remainder
of Grant 4719 to J. R. Cadinha;
7. 232° 19' 205.00 feet along Lot 3B, remainder of
Grant 4719 to J. R. Cadinha to
the point of beginning and con-
taining an area of 1.000 Acres.
"All as outlined in red on the map attached hereto, marked
Exhibit 'A' and by reference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect forthwith
upon the conditions that (A) the petitioner or his authorized representa-
tive shall obtain tentative subdivision approval within one (1) year from
the effective date of approval of the change of zone. The petitioner or
his authorized representative shall be responsible for securinc final
subdivision approval; and (B) all other applicable rules, regulations and
requirements shall be complied with. Should any of the foregoing condi-
tions not be met, action to change the subiect area to its oric;inal or a
more appropriate zoning designation may be initiated..
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of
this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
