ORDINANCE No. 39 4
AN ORDINANCE AMENDING SECTION 7.09 THE KAMUELA ZONE MAP OF
CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL
(A-la) TO AGRICULTURAL (A-5a) AT PUUKAPU HOMESTEADS, 2ND :;ERIES,
SOUTH KOHALA, HAWAII, COVERED BY TAX MAP KEY 6-4-18:57.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.09 of Chapter 8 (Zoning Code), Article
2, Hawaii County Code, as amended, is hereby further amended by
adding thereto the following subsection:
~~7,p9 ( j), The district classification of the
following area situated at Puukapu Homesteads, 2nd Series,
South Kohala, Hawaii, shall be Agricultural (A-Sa):
Beginning at a pipe at the north corner of this parcel of
land being the west corner of Lot 102, Grant 9567 and on the
south side of Mamalahoa Highway, the coordinates of said
point of beginning referred to Government Survey Triangulation
Station "EAST BASE" being 5,598.20 feet. North anal 774.80
feet West and running by azimuths measured clockwise
from True South:
1. 346° 10' 3,110.82 feet along Lot 1C2,
Grant 9567 to a pipe;
2, 76° 10' 600.00 feet along Mana I:oad to a
pipe;
3. 166° 10' 3,119.20 feet along Grant 7766 to a
pipe;
4 2560 58' 600.06 feet along south side of
. Mamalahoa Highway to the
point of beginning and
containing an area of
42.906 Acres.
"All as outlined in red on the map attached hereto,
marked Ex hibit 'A' and by reference made a part hereof."

SECTION 2. Section 1 of this ordinance shall take
effect forthwith upon the conditions that (A) that the
petitioners or their authorized representative shall secure final
subdivision approval within one year from the effective date of
approval of the change of zone; (B) that within three (3) years
from the receipt of final subdivision approval, two of the
proposed lots shall be used for agricultural purposes in
accordance with the State Land Use Commission's definition of
agriculture; and (C) that all other applicable rules, regulations
and requirements shall be complied with.
Should any of the foregoing conditions not be met,
rezoning of the subject area to its original or a more
appropriate zoning designation may be initiated.
SECTIOYd 3. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTIODI 4. This ordinance shall take effect upon its
approval.
