General Provisions SECTION 1. TITLE. This Chapter shall be known as the Electrical Code, may be cited as such, and is referred to herein as "this Code." SECTION 2. PURPOSE. The. purpose of this Code is to reduce the hazards to persons and prc•perty from electrical causes. To accomplish this, the requirements set forth herein are intended to provide a minimum standard fox electrical installations in the County of Hawaii. SECTION 3. SCOPE. The I~rovisions of this Code shall apply to all electrical work and in=_tallations in the County, with excep- tions as covered by Section 90-2(b) of the 1978 National Electrical Code and the following: A. Electrical work c,n buildings or premises owned by or under the direct control of the United States. B. Electrical work by employees of a public utility within the State under a franchise ox' charter granted by the State which is regulated by the Public Utility Commission and community antenna television company, while so employed, pursuant to Section 448E-13, Hawaii Revised Statutes. C. The provisions oi: this Code shall not apply to a Municipal System for street l:.ghting, traffic signal or police and fire alarm where installed outside of buildings on public F~roperty. The physical placement and re<~ssembly of an electric sign, x-ray equipment or household appliance. D. Existing electrical installations which complied with the laws, ordinances and regulations in effect when the electrical work thereon was performed, provided that such installations shall be subject to the provisions of :subsection C of Article B, Section 1, hereof. E. Electrical work i.n accordance with the laws, crdinances and regulations in effect prior to the effective date of this Code under a permit therefor issued prior to such date. F. All buildings moved into or relocated within the County shall comply with all requirements of this Code for new buildings and all unused or abandoned wiring and device shall be remcved. G. Electrical work x•elated to work regulated by Chapter 22 of Rule XX of the Department cif Labor and Industrial Relations of the State of Hawaii, relating to the Elevator Code, but not including electrical work for the supply of power to the control panels of elevators, dumb-waiters, escalators, moving walks and manlifts. H. Replacement or repair of devices and apparatus of air conditioning and refrigeration systems, except electrical work on overcurrent devices which are not physically attached to, cr physically mounted on, such s}•stems. I. The construction, alteration or repair of electrical devices commonly used in the kiome such as T.V, sets, radios, tape recorders, movie projectors and the like. J. All Class I circuits shall require an electrical permit. SECTION 4. INTERPRETATION-SAME SUBJECT MATTER. If tYere are two or more provisions in this: Code or any other ordinance or statutes, covering the same subject matter, the provisions which provide the greater safety to life or limb, property or puklic welfare shall prevail. - 2 - AF:mICLE 2. Definitions SECTION 1. DEFINITIONS. The following words and phrases when used in this Code shall Y.ave the meaning respectively ascribed to them in this section, unle~.s it is apparent from the context that a different meaning is ir:tended. A. ADMINISTRATIVE AL!THORITY. Whenever the term "Adminis- trative Authority" is used in this Code, it shall be construed to mean the Chief Engineer of HdF~dll County Department of Public Works or his authorized representative. B. ASSISTANTS. Wherever the term "assistants" is used in this Code, it shall be construed to mean the authorized repre- sentatives of the Administrat~.ve Authority. C. APPRENTICE. A person who performs electrical work under the direct supervision «nd in the presence of a supervising electrician, supervising spec~.alty electrician, journeyman elec- trician, journeyman specialty electrician. D. BOARD. The Board of Appeals. E. DEPARTMENT. The Department of Public Florks of the County of Hawaii. F. ELECTRICAL CONTRACTOR. Any person who is licensed under the provisions of Chapter 444, Hawaii Revised Statutes, and possess a valid unexpired and unrevoked license qualifying him to perform electrical work. G. ELECTRICAL SPECIALTY CONTRACTOR. Any person who is licensed under the provisions of Chapter 444, Hawaii Revise+d Statutes, and possess a valid unexpired and unrevoked license qualif}•ing him to perform electrical speciality work. H. ELECTRICAL WORK. The installation, alteration, recon- struction, or repair of electrical wiring. I. ELECTRICAL WIRIN~~. Any conductor, material, device, fitting, apparatus, appliance, fixture or equipment, const:_tuting - 3 - a part of or connected to any -electrical installation, attar:hed or fastened to any building, structure or premises and which i~istalla- tion or portion thereof is designed, intended or used to ge:ierate, transmit, transform or utilize electrical energy within the scope and purpose of the National Electrical Code referred to in section 1 of Article 5 of this Code. J. EMERGENCY ELECTRICAL WORK. Repair of electrical wiring to restore electrical service to a k>liilding following a fire, remedy a power failure and protect persons and property against short cir- cuiting and open circuits. K. JOURNEYMAN ELECTRICIAN„ Any person who has been licensed by the Board of Electricians and Plumbers as a journeyman electrician under the provisions of Chapter 448E, Hawaii Revised Statutes. L. JOURNEYMAN SPECII~LTY ELECTRICIAN. Any person who has been licensed by the Boarci of Electricians and Plumber" as a journeyman specialty electrician under the provisions of Chapter 448E, Hawaii Revised Statutes. M. MAINTENANCE WORK. The keeping in repair and operation of any electrical installatio:i, apparatus, fixtures, appliscnce or equipment. N. MOTION PICTURE OPERATOR. Any person who has been licensed by the Board of Electricians and Plumbers as a motion pic- ture operator under the provisions of Chapter 448E, Hawaii Revised Statutes. 0. PERSON. Any individual, firm, partnership, associa- tion or corporation, provided that a firm, partnership, association or corporation are not incluc.ed within the meaning of person found in the definitions for journeyman electrician, journeyman specialty electrician, supervising electrician, supervising speciality elec- trician, and motion picture operator. - 4 - P. SUPERVISING ELECTRICIAN. Any person who has been licensed by the Board of Electricians and Plumbers as a suL~ervising electrician under the provisions of Chapter 448E, Hawaii Revised Statutes. Q. SUPERVISING SPEC:rALTY ELECTRICIAN. Any person who has been licensed by the Board of Electricians and Plumbers a :;uper- wising specialty electrician ixnder the provisions of Chapter 448E, Hawaii Revised Statutes. R. INUNDATION LEVEL. Maximum expected water level due to flooding by rainfall runof_, wind waves and tsunamis as estab- lished by the Administrative ;authority. S. WATER-TIGHT. ReFerence to water-tight construction below the inundation level shall mean constructed to exclude mois- ture and withstand the hydraulic pressure resulting from the antic- ipated depth of inundation. - 5 - A?:TICLE 3. Administration and Enforcement SECTION 1. £,DMINISTRATION AND ENFORCEMENT. A. DEPARTMENT HAVING JLIRISDICTION. Unless otherwise provided for by law, the Department of Public Works of the County shall have jurisdiction over <rnd administer all matters co~~ered by this Code. B. RIGHT OF ENTRY. Whenever necessary to make are in- spection to enforce any of th~~ provisions of this Code, or whenever the Administrative Authority or his Assistant has reasonable cause to believe that there exists :in any building, structure or premises hazards to persons and proper~y from electrical causes, the: Adminis- trative Authority or his Assistant may enter such building, structure or premises at all reasonable times to inspect the same or to per- form any duty imposed upon the Administrative Authority by the Code; provided, that if such building, structure or premises are unoccupied, he shall first make a reasons:~le effort to locate the owner or other persons having charge or control of the building, structures or premises and demand entry. If such entry is refused, the 1~dministra- tive Authority or his Assistant shall have recourse to every remedy provided by law to secure entry. C. INSPECTION AND PROCEDURES. 1. All electrical wiring, for which a permit is re- quired, shall be inspected an3 approved by the Administrative Author- ity before being concealed, energized or used. All fees r~:quired by this Code shall be paid by the permittee prior to the energizing or use of such wiring. 2. No person shall use, operate or maintain, or cause or permit to be used, operated or maintained, any electric wiring until it is inspected and approved. - 6 - 3. No serving :agency shall supply, or cause or permit to be supplied, electric energy to any electric wiring uni:il the wiring has been inspected and approved. EXCEPTION. Temporary construction services as prescribed under this Code and to be usE~d during construction only. 4. No person shall conceal, enclose or cover, or cause or permit to be concea.Led, enclosed or covered, any portion of any electric wiring or equipment in any manner which w:.ll inter- fere with or prevent the inspection and approval thereof. 5. Fixtures, appliances, devices or equipment shall not be connected to any electric wiring until the rough electric wiring, including conductors have been inspected and approved, except as otherwise satisfactory to the Department. 6. All obstructions, covers, plates, tapes, etc., which makes impracticable the making of a thorough inspection o:' electric wiring shall be removed upon notice (either verbal or in writing) to do so, and shall be kept removed until the electric wirin~3 has been inspected and approved. D. DEFECTIVE ELECTRICAL INSTALLATIONS. Whenever any elec- trical installation is found to have been installed, altered, changed or reconstructed contrary to the provisions of this Code ~r any other law, whenever any electrical installation is found to be in use con- trary to the provisions of this Code or any other law, or whenever any electrical installation, which complied with the existing laws, ordinances and regulations in effect when the electrical work thereon was performed, is found to be unsafe or dangerous to persons or prop- erty, the Administrative Authority shall give the owner or the person in control of such installation a written notice stating the findings with respect to such installation and order the owner or such other person to make the correcticns to be set forth in such written notice. - 7 - E. REQUEST FOR INSP1'sCTION. Whenever any work regulated by this Code, or any portion thereof, is ready for inspection, the Administrative Authority shah. be notified by the person that same is ready for inspection. The notice shall be in writing or. forms furnished by the Administrati~~e Authority, or may be by telephone at the option of the Administrative Authority. The notice shall be filed with the Department riot less than 48 hours and not. more than 72 hours before any such inspection is desired. 1. The Administrative Authority shall proceed to in- spect the same within 48 hour:>, not including Saturdays, Sundays or holidays, after receipt of such notice, and if said work: conforms in all respects with the prov:Lsions of this Code, he shall attach a notice granting authority to ~~roceed with installations. 2. No electrica:~ wiring shall be covered or concealed until the said 48 hours have expired after notice to the Adminis- trative Authority has been re~:eived in his department, or until the Administrative Authority has ~ipproved the installation and given permission to cover or conceal the same. Should the Administrative Authority condemn any of said work or equipment as not being in accordance with the provisions of this Code, notice in wrii:ing to that effect shall be given by him to the person engaged in the work. 3. Within a reasonable time thereafter such work or equipment shall be altered or removed as the case may requ:_re, and necessary changes shall be made so that all such work and equipment may fully comply with the proaisions of this Code before further work is connected on or with such condemned work or equipment. In default, said Electrical Contractor shall be liable to the penalties provided in this Code, and any and every owner, contractor or other person engaged in construction of the building or structure, or otherwise, covering or allowing to be covered such portion of work or equipment, or removing any notice not to cover same pla~~ed thereon - 8 - by the Administrative Authority shall likewise be liable to the penalties in this Code provided. F. FINAL INSPECTION REQUIRED. 1. No person shall use or supply electrical e~iergy to any electrical installation on which. electrical work was or is being performed under a permit issue3 pursuant to the provisions ~~f this Code before the Administrative Authority has approved such installa- tion. 2. Whenever electric wiring has been approved, a certificate of inspection therefor shall be issued on deman3, pro- vided all fees required by this Code have been paid. 3. The Supervising Electrician shall be prese~it on job site upon the request of the Administrative Authority. SECTION 2. RESPONSIBILITY FOR COMPLIANCE. Every pers~~n installing, altering, repairing, using or maintaining electric wiring shall be responsible for compliance with this Code. SECTION 3. NON-LIABILITY OF COUNTY FOR DAMAGES. A. LIABILITY OF PERSONS. This Code shall not be construed to relieve from or lessen the responsibility of sxch person owning, operating or installing any electrical wires, appliances, apparatus, construction or equipment for damages to any one injured by any defect therein. B. NON-RESPONSIBILITY OF COUNTY. Neither the County of Hawaii, nor any department, board, commission, officer, employee, or the Administrative Authority thereof shall be Held liable or responsible for any damage or injury caused by or resulting from the issuance of any permit issued, or any inspection or approval or issuance of a certificate cf inspection, made under the provisions of this Code. - 9 - AR'CICLE 4. Permits and Fees SECTION 1. PERfdITS REQUIRED; EXCEPTIONS. A. PERMIT REQUIRED AdD EXCEPTIONS. No person sha:.l per- form any electrical work or cazse or permit the same to be clone, unless a permit therefor has b~=_en obtained from the Administ=rative Authority with the following exceptions: 1. Electric work and installations to which ttie provisions of this Code are expressly declared to be not applicable. 2. Installation of any portable motor or other- por- table appliance energized by maans of a cord or cable having an attachment plug and, if such card or cable is permitted by •.his Code. 3. Repair of any fixed motor or other applian~:e, or replacement of any fixed motor with another having the same horse- power rating and situated at t'~e same location. 4. Replacement of attachment plug receptacles, but not the outlet therefor. 5. Maintenance work by a properly licensed el~:ctrician. 6. Emergency electrical work by a person to w)iom a permit may be issued. 7. Radio and television receiving antenna systems other than master or community systems in or about commercial and industrial buildings, including hotels, multiple family dwellings, and apartment houses. 8. Sound recording systems for a single-family or two-family dwelling. 9. The provisions of the foregoing exceptions shall not apply to any repairs or replacements of electrical devices, apparatus, or appliances which were originally installed without a permit when such permit is recuired for the original installation, or when energized by, or which is a part of any hazardous or illegal wiring system. - 10 - 10. The foregoinc exceptions from permit requirements shall not be deemed to allow zny electric wiring to be done in a manner contrary to other provisions of this Code. B. SCOPE OF PERMIT. 1. The issuance of a permit is not an approval or an authorization of work specified therein. A permit is merely an application for inspection, tl-e issuance of which entitles the permittee to inspection of thF work which is prescribed therein. 2. Neither the issuance of a permit nor the approval by the Administrative Authority of any document shall constitute an approval of any violation of zny provision of this Code or of any other law or ordinance, and a permit or other document purporting to give authority to violate a,ny law shall not be valid with respect thereto. C. EMERGENCY WORK. When emergency electrical work is commenced without a permit, ari application for a permit fox the work shall be made pursuant tc~ the provisions of Section 3 of Article 4 hereof as soon as possible after the work is commenced. SECTION 2. SEPARATE PERPIITS. A separate permit shall be obtained for each building or structure, except that a permit for a main building may include electrical work for a private rarage, shed, or accessory building located on the same premises a: the main building, and supplied b~~ a feeder or circuit from the main building. SECTION 3. APPLICATION ]'OR PERMIT. A. FILING. To obtain a permit, the applicant shzill file an application on forms furnished by the Administrative Authority. The application shall contain all information necessary to the lawful enforcement of the provisions of this Code. B. PLANS AND SPECIFICATIONS. The application shall be accompanied by approved plans and specifications or a suitable dia- gram when and as required by Section 4 of Article 4 hereof. - 11 - C. ISSUANCE OF PERM;:T. When the Administrative Futhority determines that the information on the application and plans is in conformance with this Code, ttie Administrative Authority stall issue a permit upon receipt of the total fees. D. EXCEPTIONS. Not}ling contained in this Code shall be construed to require the Administrative Authority to immediately accept or reject any application, whenever it is necessary to in- vestigate the proposed wiring and premises as to its compliance with this Code, or it is necessary to check plans and specifications accompanying the application. SECTION 4. PLANS AND SPf:CIFICATIONS. Plans and specifications giving such details of the proposed installation as may be required by the Administrative Authority shall be filed with the application. Such plans and specifications shall bear the approval of either a professional engineer registe~•ed in the State of Hawaii as especially qualified in the electrical branch of engineering, or a professional architect or other engineer rE~gistered in the State of Hawaii and qualified in such work by experience, provided that if the demand load of the proposed installation is less than thirty (30) kilovolt- amperes, this requirement sha:.l be applicable only if the F.dminis- trative Authority so directs. No person shall material:'.y deviate from any approved plan or specifications or fail, ne<71ect or refuse to comply therewith, unless permission to do so ha:; first been obtained from the De- partment. SECTION 5. ISSUANCE. I: the Administrative Authorit}• is satisfied that the installation described in the application will conform to the provisions of '.his Code and all pertinent le~ws, and the fee prescribed in Section 10 of Article 4 hereof has been paid, he may issue a permit to the }persons specified in Section t~ of Article 4 hereof. - 12 - SECTION 6. PERSONS TO WHOM PERMITS MAY BE ISSUED. A F~ermit to do electrical work regulated by this Code may be issued only to: A. A home owner for electrical work on a single )'amily dwelling regulated by this Code and used exclusively for li~~ing purposes, including the usual +~ccessory buildings on the sane property, provided that said work be performed by a person =.icensed under Chapter 448E, HRS; provided further that the home owner shall furnish the name and license nimber of said person licensed under Chapter 448E, HRS, at the time of application for the permi?=. Only one such permit may be issued to such a home owner, unless the Administrative Authority find that strict application would result in practical difficulty and hardship and that the granting of a second permit would not be contrary to the purpose of the Code. B. A contractor who is licensed under the provisions of Chapter 444, Hawaii Revised Statutes, and possesses a valid, unexpired, unrevoked license which qualifies him to perform electrical or electrical specialty work and who has a supervising electrician or a supervising specialty electrician under his employment. C. A supervising electrician or supervising specialty electrician 1. Who is employed as a maintenance electrician by someone other than a contractor described above; or 2. Who is donating his services to an eleemosynary institution for temporary electrical installation; or 3. Who is employed by the County or State. 4. Who is applying for electrical work for his own dwelling. SECTION 7. CONTENT; POS"ING; WHEN NULL AND VOID. Every per- mit shall be issued in such form and detail as shall be prescribed by the Administrative Authority, shall specify the geograpk~ical location of the premises wherE~on the work authorized therek~y is to - 13 - be done, shall be valid onlg for the location so specified, and shall be conspicuously posted by the holder thereof on the premises. If the work authorized by ar~y permit shall be continuously suspended for a period of ninety (90) days, such permit shall thereupon, and thereafter, be null and voie.. SECTION 8. TRANSFERAB].LITY. No permit shall be assigned, transferred or loaned to another by the person to whom it was issued. SECTION 9. SUSPENSION OR REVOCATION. The Administrative Author- ity may, in writing, suspend or revoke a permit issued under provisions of this Code whenever the permit has been issued in error or on the basis of incorrect information supplied, or in violation of any ordinance, regulation or provision of this Code. In sucY event, the permit fee shall not be refunded. SECTION 10. PERMIT FEF~S. A. TO WHOM PAID. A fee in accordance with the schedule set forth hereinafter shall be paid to the Director of Finance for each permit. B. SCHEDULE. 1. Issuing Permits. A fee shall be paid fcr issuing each permit in addition to all other charges specified herein . $3.00 each. 2. Service In::tallations. A "portable electric sign" means a small advertising contrivance operated with electricity and used in interior cif build- ings only which is capable of '~eing moved or removed at wil:!_ without damaging or altering the structure or finish at or adjacent to the location thereof, and which is not attached or fastened in ~>lace by nails, screws, bolts, conductors, wiring enclosures or in a~iy other manner. No fee shall be required for such portable electric: signs when the outlet and circuit to which it is attached has bee~i installed pursuant to a valid permit. 14. Lighting Fixtures. For each set of ten fixtures or fraction thereof: (fees to be charged only when circuit wiring is excluded.) $3.00 15. Motors. For each separate motor fixed: Not over 1/3 HP $ 1.00 Over 1/3 HP tut not over 1 HP 2.00 Over 1 HP but not over 3 HP 3.00 Over 3 HP but not over 8 HP 4.00 Over 8 HP but not over 15 HP 5.00 Over 15 HP bit not over 50 HP 6.00 Over 50 HP b~.t not over 100 HP 7.00 Over 100 HP 15.00 16. Temporary Motors, Installation. First 2 circuits $9.00 Each additional circuit 2.00 No fee shall be required for moving any temporary construction motor from one pace to another, when such temporary - 19 - motor is attached to an outlet for which a permit has been :_ssued and the permit fee therefor ha,s been once paid. No temporary meter loop assembly shall be r-elo- Gated without payment of permi~ fee as set forth herein. Temporary mot~~r installations for carnival rides, etc., a flat fee of $25.00 shall be charged. 17. Generators, Capacitors, Reactors and Trans:`.ormers Fixed. For the purpose of this subsection 1 KW is equiva- lent to 1 KVA. Not more than 5 KW $ 4.00 Over 5 KW but not over 15 KW 10.00 Over 15 KW 15.00 18. Miscellaneous. Each motion picture projection machine using 35 mm or larger film $10.00 Each X-Ray machine outlet 4.00 Each Dental Chair outlet 5.00 Each Electric Organ outlet 3.00 Each Electric Welder outlet 4.00 Each Street Lighting Standard or fixture 3.00 For conduit and raceway installation, a fee of $3.00 shall be charged for each 200 lineal feet of conduit and race- way or any fraction thereof. (Fees are to be charged only when cir- cuit wiring is excluded.) 19. Repairs, alterations, additions. Fermit fees for additions to or alterations of existing work shall be the sane as for new work. Permit fees for repair or for work for which a permit is required but for which no fee is herein provided shall be $3.00. - 20 - C. WORK WITHOUT A PE3MIT. Where work for which a permit is required by this Code is st;~rted or proceeded prior to obtaining of said permit, the fee shall :~e fifty dollars ($0.00) plus; the fees specified by Subsection B above or the fees specified by Subsection B above be doubled, whichever is greater, but payment of such fee shall not relieve any persons from fully complying with the requirements of this code in the execution ~~f the work nor from any other- penalties prescribed herein. This provision does not apply to emerge icy work when proved to the satisfactiosz of the Administrative Author-ity that such work was urgently necessary and it was not practical to obtain a permit therefor before the commencement of work. In all ;>uch cases a permit must be obtained as soon as it is practical to do :so, and if there be an unreasonable delay in obtaining such a permi~~, the penalty will be charged. D. EXEMPTIONS. The ~ounty of Hawaii and all cunt:^actors performing work under authority of said County shall be exempt from the requirements to pay permit fees. SECTION 11. CHARGES FOR EX"_'RA AND MISCELLANEOUS INSPE~~TIONS. A. EXTRA INSPECTIONS. I£, after notice to a permit holder, more than one inspection is ne^essary to insure that deficient or defective electrical work under the permit has been corrected, the holder of the permit shall pay the Director of Finance twenty dollars ($20.00) for each additional inspection. B. MISCELLANEOUS INSPECTIONS. For the inspection of any electrical installation, not covered by a fee specified in this Code, the person requesting the insfection shall pay the Director of Finance fifteen dollars ($15.C0) for each hour or portion thereof that is required to make the inspection and travel to and from the installation. - 21 - AR'^ICLE 5. Standards SECTION 1. STANDARDS FOR ELECTRICAL WORK. A, ADOPTION OF THE N.'~TIONAL ELECTRICAL CODE. The National Electrical Code, 1978 Edition, copyrighted 1977 by the National Fire Protection Association, 470 Atlantic Avenue, Boston, Massac:iusetts, 02210, is hereby adopted by reference and made a part hereof. Three copies of said Code shall be kept on file and be available `or public inspection in the County Clerk's Office. The scope, techni~:al speci- fications and exemptions set forth in said Code are hereby ,adopted as the standard for electrical work covered by the Code, pr~~vided there are no specific provision in any other section of this Code covering the particular matter. B. COMPLIANCE REQUIRED. No person shall do or cause to be done any electrical work which does not comply with the arovisions of this Code. SECTION 2. STANDARDS FOR PERFORMANCE OF ELECTRICAL WORK. No person shall perform any work covered by this Code in violation of the provisions of Chapter 448b, Hawaii Revised Statutes. SECTION 3. QUALIFICATIOr OF PERFORMANCE OF WORK UNDER THE ELECTRICAL CODE. A. Compliance with the fawaii Revised Statutes: It shall be unlawful for any permittee to perform or allow to be performed any work covered by the permit is:.ued under this Code in violation of Chapter 444, Hawaii Revised Statutes, relating to the licensing of contractors, and Chapter 448E, Hawaii Revised Statutes, relating to the licensing of electricians and plumbers. B. Any person engaged iii a business involving performance of electrical work covered by th:_s Code, shall maintain a place of business in a business or ind~istrial zone in accordance to the provisions of Zoning Ordinanc«~ No. 63 of the County of Hawe«ii, with - 22 - a listed telephone number and `~e principally engaged in said busi- ness during the normal business hours for said place of bus:~ness. SECTION 4. APPEALS AND PETITIONS. Any appeal from the deci- sion of the Administrative Aut'zority in the administration of the County of Hawaii Electrical Co 3e involving any denial of thca use of new or alternate materials, types of construction, equipment, fixtures, devices or appliances, or any petition for varyin~T the application of the Electrical ode may be submitted to the Board of Appeals for hearing and determination as specified in Section 204, Uniform Building Code, as amended, under Section 6, Ordinance 93 of the Revised Ordinance of the County of Hawaii 1975, a;> amended. SECTION 5. PENALTY. Any person, firm or corporation ~~iolating, or failing to comply with any ~f the provisions of this Code, shall upon conviction thereto be punished by a fine not exceeding Five Hundred Dollars ($500.00). Ea^h separate day or portion thereof during which any violation of this Co~?.e occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. SECTION 6. OFFENSES UNDER. FORMER ORDINADTCES SAVED. Nothing contained in any provision of this ordinance shall apply to an act done or omitted, or to an offense committed at any time before the enactment of this ordinance. Such act or omission shall be governed by, and any such offense shall be punished according to the provi- sions of the ordinances existing when such act, omission or offense, occurred in the same manner as if this ordinance had not been enacted. - 23 - AR'^ICLE 6. Amending the National Electrical Code SECTION 1. AMENDING SECTION 6~0-4 OF THE NATIONAL ELECTRICAL CODE. Section 600-4 is amended to read: "Every electric sign ~~f any type, fixed or portablE~, shall be listed or approved. EXCEPTION: Such approval will not be required provided: 1. The sign is constructed and assembled of approved components in accordance with recognized standards. 2. The sign is inspected and approved before erection." SECTION 2. AMENDING THE NATIONAL ELECTRICAL CODE. The National Electrical Code is amended by adding the following: "Rain water and Sea taster Flooding Standards. The follow- ing paragraphs shall supplement the requirements of the National Electrical Code for electrical work subject to inundation b~~ rainfall run-off or sea waves: 1. Services: a. Location. Service Equipment shall be Located above the inundation level or shall be installed in water-tight enclosure, room, or vault, and shall be readily accessible in any case. b. Ground Fault Protection. Ground fault protection shall be provided for all grounded wye electrical services. 2. Ground Fault Protection: a. Approved ground fault circuit protection shall be provided for all feeder anc branch circuits below or extending into inundation level. 3. wiring MethoE and Material: a. Distribution Ec~~zipment. Equipment such as transformers, fuses, panelboards, switchboards, disconnects, circuit breakers, controllers and other devices used for control, - 24 - disconnecting means, ground fault protection, or overcurrent protec- tion shall be located above the inundation level, unless made of water-tight construction." 4. The Chief Engineer shall have the authority to consider exceptions to the provisions of the requirements of this Section and may grant variance from the provisions thereof, if local topographic conditions clearly indicate that the possibility of flooding is not present." - 25 - ARTICLE 7. Rapeal SECTION 1. REPEAL OF PRIOR ORDINANCE, PRESERVATION OF RIGHTS AND LIABILITIES, CONSTRUCTION JF REVISED ORDINANCE. A. REPEAL OF PRIOR ORDINANCE; WHAT NOT REPEALED. All ordinances, sections and Ordinances of the County of Hawaii, in conflict herewith, be and the same is hereby repealed. B. PRESERVATION OF RIGHTS AND LIABILITIES. Said .repeal shall not affect any act done, ratified or confirmed, or and right accruing or accrued or established, or any action, suit or proceeding had or commenced in any civil cause, prior to said repeal, gut all rights and liabilities under any ordinance embraced in the said ordinance or so repealed shall continue, and may be enforcefl in the same manner and with the same effect as if said repeal had not been made. C. CONSTRUCTION OF REVISED ORDINANCES. Provisions in said ordinance shall be construed as continuations or amendments of applicable or corresponding provisions of previously existing laws and not as new enactments.
