A BILL FOR AN ORDINANCE REPEALING SECTION 7, ARTICLE 10, CHAPTER
2 OF THE HAWAII COUNTY CODE AND SUBSTITUTING A NEW SECTION RE-
LATING TO COUNTY VEHICLE TAXES AND FEES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7, Article 10, Chapter 2, Hawaii County
Code, is hereby repealed in its entirety and replaced by the
following:
"SEC. 7. COUNTY VEHICLE TAXES.
SEC. 7.01. IMPOSITION OF TAX. Except as otherwise orovided
in Sections 249-1 to 249-13, Hawaii Revised Statutes, all
vehicles and motor vehicles, as defined in Section 249-1,
located in the County of Hawaii at the time of registrati~~n
shall be subject to an annual tax computed according to tae
net weight of each vehicle in the manner hereinafter provLded.
The tax shall become due and payable on January 1 and mus= be
paid before April 1 in each year. The tax shall be paid by the
owner of each vehicle and collected by the Director of Fi~iance;
provided that if any such vehicle is transported into thi;~
County after the payment of such tax, no additional tax shall be
imposed on such vehicle for the remaining period of the yf~ar
for which such tax has been paid.
SEC. 7.02. TAX RATES.
A. The rate for m~~tor vehicles designed primar.~ly for
carrying passengers shall be one-half (1/2) of a cent: per
pound of the net weight of such vehicles. This category
shall include buses, am~ulances and hearses.
B. The rate for trucks or noncommercial motor ~~ehicles
having a net weight of 1,500 pounds or less and cert=_fied as
noncommercial shall be ~~ne-half (1/2) of a cent per ~~ound
of the net weight of su~;h vehicles.
1. The owner of such truck or noncommercial
motor vehicle who desires to have such vehicle taxed
at the passenger rate shall file a form furnished by
the Director of Finance certifying that the truck
or noncommercial motor vehicle is not being and will
not be operated fcr compensation or for commercial
purposes.
2. Where the vehicle is currently registered
as a commercial vehicle and the owner wishes to
reclassify the veY.icle under this category, the owner
shall: (a) file z form furnished by the Director of
Finance certifyinc that the vehicle is not being and
will not be operated for compensation or commercial
purposes; (b) surrender the vehicle's current certifi-
cate of registration and license plates; and (c) pay
a fee of Four Dol]ars ($4.00) for the passenger vehicle
license plates anc emblem.
C. The rate for t-rucks or non-passenger vehicles
used for compensation or commercial purposes or having a
net weight of over 6,500 pounds shall be one (1) cent per
pound of such vehicle. This category includes trucks,
truck-tractors and road tractors, trailers and semi-
trailers.
SEC. 7.03. MINIMUM TA}:. The minimum tax assessed and
collected by reason of this section shall in no case be less
than Six Dollars.°0$6.00).
SEC. 7.04. FEES FOR MOTOR VEHICLE REGISTRATION.
A. The fee for i:;suance of a new series of number
plates for a vehicle shall be Three Dollars and Fifty
Cents ($3.50).
B. The fee for i:;suance of a tag or emblem fox' a
vehicle, upon payment of the applicable tax, in any year

in which the number plates do not evidence the payment
of the current year's tax, shall be Fifty Cents ($.`>0).
C. The fee for a replacement of a lost or mut--lated
number plate or plates, tag or emblem of a vehicle :;hall
be as follows:
1. Number plates $3.50
2. Tag or emolem .25
D. The fee for original registration of a veh_.cle
in any year in which tze number plates do not eviderce the
payment of current year's tax shall be Three Dollars and
Seventy Five Cents ($3.75).
SECTION 2. This ordinance shall take effect on
January 1, 1979.
