AN ORDINANCE AMENDING SECTION 7.29 'CHE CITY OF HILO ZONE MAP OF (:HAPTER 8
(ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHA}1GING THE
DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10) TO MULTIPLE
FAMILY RESIDENTIAL (RM-4) AT WAIAKE.~ HOMESTEAD HOUSELOTS, WAIAKEi~, SOUTH
HILO, HAWAII, COVERED BY TAX MAP KE'Z 2-2-38:12.
BE IT ORDAINED BY THE COUNCIL OF TH3 COUNTY OF HAWAII:
SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article: 2, Hawaii
County Code, as amended, is hereby Further amended by adding the-eto the
following subsection:
"7.29(jjj). The district classification of the following area
situated at Waiakea Homestead 3ouselots, Waiakea, South Hil~~, Hawaii,
shall be Multiple Family Residential, (RM-4):
Beginning at an iron pipe at the North corner of this lot avid the
West corner of Lot 12, Block 301, on the South side of KawiLi Street,
the coordinates of said point of beginning referred to Government
Survey Trig. Station "Halai" being 9.565.0 feet South and 8512.5 feet
East as shown on Government Survey Registered Map No. 2600, and run-
ning by true azimuths:
1. 328° 10' 360.0 feet along I.ot 12, Block 301, to an iron pipe;
2. 58° 10' 242.0 feet along i.ot 7, Block 301, to an iron pipe;
3. 148° 10' 360.0 feet along hots 8 and 9, Block 301, to an iron
pipe;
4. 238° 10' 242.0 feet along the South side of Kawili Street to
the pcint of beginning and containing an area of
2.0 acres, or thereabouts.
"All as out lined in red cn th e map attached hereto, marked Exhibit
'A' and by reference made a part hereof."
Section 2. Section 1 of this ordinance shall take effect forthwith upon
the conditions that (A) plans for t:he entire development shall to submitted
for Plan Approval within one (1) year from the effective date of the change
of zone. Construction shall commence within one year of the receipt of Final
Plan Approval and be completed wit}iin two (2) years thereafter; (B) as part
of the Plan Approval submittal the applicant shall include a dr~~inage and
grading plan for the review and approval of the Chief Engineer; (C) the appli-
cant shall delineate a drainage easement on the drainage and grading plans
meeting with the approval of the Chief Engineer. Further, the e,~sement line
shall be considered as a property line for the purpose of determining
structural setbacks; (D) the State Department of Health's and Cointy Depart-
ment of Water Supply's Rules and Regulations shall be complied with; (E) the
design of any and all structures on the subject property shall tyke into
consideration the surrounding residential. character of the area; and (F)
all other rules and regulations shall be complied with. Should any of the
foregoing conditions not be met, the rezoning of the area of its original
or a more appropriate designation nay be initiated.
SECTION 3. In the event that any portion of this ordinance is declared
invalid, such invalidity shall not affect: the other parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
