HomeMy WebLinkAboutORD 1978-400 1976-1980y BILL No. 430 COUNTY OF HAWACI - STATE~~Q~OF~y,~~~HAWAII ORDINAN~JE NOe ,r , ~1~+a/ AN ORDINANCE AMENDING SECTION 7.05 'PHE KAILUA-HONALO URBAN ZONE 17AP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY"~.CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICA'PION FROM SINGLE FAMILY RESIDENTIAL (RS-15) TO SINGLE FAMILY RESIDENTIAL (RS-7.5) AT KAWANUI 1ST, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-9-14:42. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.05 of Chspter 8 (Zoning Code), Articlf~ 2, Hawaii County Code, as amended, is zereby further amended by add:ing thereto the following subsection: "7.05 (w). The district classification of the following area situated at Kawanui 1st, North Kona, Hawaii, shall be single family residential (RS-7.5): Beginning at a pipe at the southwest. corner of this parcel ~f land at the southeast corner of Parcel C and on the North side of a 20 feet wide roadway the coordinates of said point of beginning referred to Government Survey Triangulation Station "PUU O HAU" being 10,178.65 feet North and 8,110.69 feet East and running by azimuths measured clockwise from true South: 1. 169° 00' 91.03 feet along Parcel C, a portion of Grant 1178 to Hapuka; 2. 2590 00' 117.06 feet along a portion of Grant 1178 to Hapuku; 3. 2440 10' 70.00 feet along same; 4. 3020 39' 28.51 feet along St. Paul Road; 5. 3430 00' 64.19 feet along Government Main Belt Road; Thence along a 20 feet radius curve to the right the chord azimuth and distance being: 6. 300 3p~ 29.49 feet along 20 feet wide roadway; 7, 780 00' ]92.55 feet along same to the point of beginning and containing an area of 19,379 square feet or 0.44 Acre. "All as outlined in red can the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section of this ordinance shall take effect forthwith upon the conditions that (A) a sincle farnily dwelling shall be constructed on the proposed lot within three (3) years from the effective date of approval of the change of zone; and (B) all other applicable rules, regulations and requirements, including those of the Department of Water Supply shall be <:omplied with. Should any of the foregoing conditions not be met rezoning of the subject property to its original or a more appropriate zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity :,hall not affect the other parts of this ordinance. SECTION 4. This ordinance shz,ll take effect upon its approval.
