AN ORDINANCE AMENDING ORDINANCE NO. 41, AS AMENDED BY ORDINANCE
NO. 90, RELATING TO A CHANGE OF DISTRICT CLASSIFICATION FROM
AGRICULTURAL (A-l0a) TO AGRICULTURAL (A-la) AT WAIAKEA HOME-
STEADS, WAIAKEA, SOUTH HILO, HAWA]:I, COVERED BY TAX MAP KEY
2-4-65:5-33.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Condition A of Section 2, Ordinance No. 41,
as amended by Ordinance No. 90, is hereby amended to read as
follows:
"(A) The area be zoned in two increments. The
first increment shall consist of twenty-six (26) lots
and the second increment the remaining lots. The
effective date of zoning for the second increment
shall be after development has occurred on the first
increment. Development is defined as building permits
issued for residential dwelling units and construc-
tion partially completed - partially completed in
the sense of having roofs on [lOJ 9 units within the
first increment to assure that a minimum of [forty
(40)J twenty-five (25) percent of the lots of the
total development are developed with buildings."
SECTION 2. This Ordinance shall take effect upon its
approval.
