ORDINANCE NO. 403
AN ORDINANCE AMENDING SECTION 7.03 7.'HE SOUTH KONA ZONE MAP OF
CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED,
BY CHANGING THE DISTRICT CLAS~IFICA7.'ION FROM SINGLE FAMILY RESI-
DENTIAL (RS-10) TO VILLAGE COMMERCIAL (CV-10) AT KEOPUKA, SOUTH
KONA, HAWAII, COVERED BY TAX NAP KES' 8-1-16:8.
BE IT ORDAINED BY THE COUNCIL OF THf; COUNTY OF HAWAII:
SECTION 1. Section 7.03 of Chzipter 8 (Zoning Code), Article 2,
Hawaii County Code, as amender, is hereby further amended by adding
thereto the following subsection:
"7.03 ( w ). The district: classification of the following
area situated at Keopuka, South Kona, Hawaii, shall be Village
Commercial (CV-10):
Beginning at a point at t:he northwest corner of this Farrel
of land, t he coordin ates of which referred to Government
Survey Tri angulation Station "7?UU OHAU" being 4802.78 feet
South and 11,678.38 feet East and running by azimuths measured
clockwise from true SoutY~:
1. 248 02' 47.48 feet along Lot 1, along
remainder of Grant 148
to Daniel Barrett;
2. 248 52' :_74.52 feet along same;
3. 248 53' 76.13 feet along Lot 3, e~long
remainder of C;rant 148
to Daniel Barrett;
4. 330 48' L26.58 feet along same;
5. 62 34' ?87.13 feet along Lot 6 acid Lot 1,
along remainder of Grant
148 to Daniel Barrett;
6. 73 08' 35.03 feet along same;
7. 160 31' 30" 153.62 feet along the eas-_erly side
of Mamalahoa Highway
to the point of begin-
ning and cont,iining
an area of 1.)1 Acres.
"All as outlined ir, red on the map attached hereto,
marked Exhibit 'A' and ky refe;rence made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect
forthwith upon the conditions that (A) parcels 8 and 9 of tax
map key 8-1-16 shall be consclidated within one year of the
effective date of approval of the change of zone request; (B) the
petitioner or his authorized representative shall submit plans
for plan approval within one year from the date of approval of
the consolidation; (C) construction of the proposed store
addition and parking improvements shall commence within one year
from the date of receipt of final plan approval and be completed
within two years thereafter; and (I>) all other applicable
rules, regulations and requizement:> shall be complied with.
Should any of the foregoing conditions not be met, action may
be initiated to rezone the sLbject area to its original or
a more appropriate zoned district.
SECTION 3. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
