AN ORDINANCE AMENDING SECTION 7.12, THE HAMAKUA DISTRICT HOMESTEADS AREA
ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY ;ODE, AS
AMENDED, BY CFIANGING THE DISTRICT CLASSIFICATION FROM AGRICULT~IRAL (A-5a)
TO AGRICULTURAL (A-3a) AT AHUALOA HOMESTEADS, AHUALOA, HAMAKUA, HAWAII,
COVERED BY TAX MAP KEY 4-6-07:68.
BE IT ORDAINED BY THE COUNCIL OF PHE COUNTY OF HAWAII:
SECTION 1. Section 7.12 of ~hapter 8 (Zoning Code), Arti~~le 2,
Hawaii County Code, as amended, is hereby further amended by a~3ding
thereto the following subsection:
"7.12(d). The district classification of the following area
situated at Ahualoa Homestea3s, Ah.ualoa, Hamakua, Hawaii, shall be
Agricultural (A-3a):
Beginning at a pipe at the Southeast corner of this parcel of land
and on the Portherly side of Honok.aa-Waimea Government Main Road,
the coordinates of said point of beginning referred to Government
Survey Triangulation Station "KUII~EI" being 6836.39 feet South and
6507.41 feet East and running by azimuths measured clockwise from
true South:
1. 77° 20'
2, 189° 52'
3. 201° 43'
4. 291° 30'
5. 23° 07'
149.00 feet along the Northerly side
of Honokaa-Waimea Government
Main Road to a pipe;
431.00 feet along the Easterly side
of 30-foot Homestead Road to
a pipe;
845.00 feet along the Easterly side
of 30-foot Homestead Road to
a pipe;
240.57 feet along the Southerly side
of 40-foot Homestead Road to
a pipe;
30" 1183.,93 feet along the remainder of
Lot 38, Grant 4170 to Kealakai
to the point of beginning and
containing an area of 6.00
Acres.
"All as outlined in rec on tYie map attached hereto, marked
Exhibit 'A' and by reference made a part hereof."
SECTION 2. Section 1 of thi: ordinance shall take effect forthwith
upon the conditions that (A) the Petitioner or his authorized representa-
tive shall submit plans for subdivision within one (1) year from the
effective date of approval of the change' of zone. The petitioner or his
authorized representative shall be responsible for obtaining final sub-
division approval; (B) the land stall remain in agricultural use; and
(C) all other applicable rules, regulatiLons, and requirements shall be
complied with.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affects the other parts of
this ordinance.
SECTION 4. This ordinance stall take effect upon its approval.
