ORDINANCE NO. 425
AN ORDINANCE AMENDING SECTION 7.03 THE SOUTH KONA ZONE MAP, ARTICLE
2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED,
BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-Sa)
TO RESIDENTIAL-AGRICULTURAL (RA-la) AT KILOA 1 & 2 AND WAIPUNAULA,
SOUTH KONA, HAWAII, COVERED BY TAX MAP KEY 8-2-03:PORTION OF 23.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.03, Article 2, Chapter 8 (Zoning Code)
of the Hawaii County Code, as amended, is hereby further amended
by adding thereto the following subsection:
"7.03 (x ). The district classification of the following
area situated at Kiloa 1 & 2 and Waipunaula, South Kona, Hawaii,
shall be Residential-Agricultural (RA-la):
Beginning at the Northernmost corner of this parcel of land,
being also the Southwesterly corner of Lot 1 of the Captain
Cook Estates Subdivision, the coordinates of said point of
beginning referred to Government Survey Triangulation Station
"LAE O KANONI" being 19,866.51 feet North and 3,493.22 feet
East and running by azimuths measured clockwise from True South:
1. 3060 41' 409.68 feet along Lot 1 of the Captain Cook
Estates Subdivision, along the remainder
of Grant 867 to Prest Cummings to a
point;
2. 400 59' 15" 173.97 feet along Lot 5-B of the Captain Cook
Estates Subdivision, along the remainder
of Grant 867 to Prest Cummings to a
point;
3. 1300 59' 15" 115.65 feet along Lot 5-B of the Captain Cook
Estates Subdivision, along the remainder
of Grant 867 to Prest Cummings to a
point;
4. 117° 39' 30" 42.33 feet along the remainder of Grant 867 to
Prest Cummings to a point;
5. 1170 39' 30" 20.34 feet along the remainder of Grant 867 to
Prest Cummings to a point;
6. 140° 30' 103.69 feet along the remainder of Grant 867 to
Prest Cummings to a point;
7. 155° 57' 71.10 feet along the remainder of Gx•ant 867 to
Prest Cummings to a point;
8. 145° 25' 30" 75.77 feet along the remainder of Grant 867 to
Prest Cummings to a point;
9. 155° 09' 30" 46.29 feet along the remainder of Grant 867 to
Prest Cummings to a point;
10. 227° 34' 21.24 feet along the remainder of Grant 867 to
Prest Cummings to the point of: beginning
and containing an area of 1.004 Acres.
"All as outlined in red on the map attached hereto,
marked Exhibit 'A' and by reference made a part hereof."
"This ordinance shall take effect forthwith upon the conditions
that (A) the petitioner or his authorized representative submit a
subdivision plan and secure tentative approval within one (1) year
from the effective date of approval of the change of zone. Tkie
petitioner/representative shall also be responsible for securing
final subdivision approval; (B) the rules, regulations and requirements
of the Department of Water Supply shall be complied with; (C) all other
applicable rules and regulations shall be complied with. Should any of
the foregoing conditions not be met, rezoning of the area to its original
or more appropriate zoning designation may be initiated."
SECTION 2. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 3. This ordinance shall take effect upon its approval.
