ORDINANCE NO. 4~A
AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP,
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM DOUBLE
FAMILY RESIDENTIAL (RD-3.75) TO OFFICE COMMERCIAL (CO-20) AT
WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-2-24:11.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning Code)
of the Hawaii County Code, as amended, is hereby further amended
by adding thereto the following subsection:
"7.29 (rrr). The district classification of the following
area situated at Waiakea, South Hilo, Hawaii, shall be Office
Commercial (CO-20):
Beginning at the Northeast corner of this parcel of land, being
also the Southeast corner of Lot 8, Block 92, Waiakea House Lots,
Second Series and on the westerly side of Kilauea Avenue, the
coordinates of said point of beginning referred to Government
Survey Triangulation Station "HALAI" being 2890.07 feet South
and 7116.62 feet East, thence running by azimuths measured
clockwise from true South:
1. 340° 06' 85.86 feet along the westerly side of
Kilauea Avenue;
2. 58° 10' 291.75 feet along Grant 9206 to Henry T. K.
Kai (lot 6);
3. 148° 10' 84.00 feet along Grant 9872 to Henry K.
Martin (Lot 9);
4. 238° 10' 309.50 feet along Grant 8583 to David McH.
Forbes (Lot 8) to the point of
beginning and containing an area
of 25,252 square feet.
"All as outlined in r ed on the map attached hereto,
marke d Exhibit 'A' and by reference made a part hereof."
"This ordinance shall take effect forthwith upon the conditions
that (A) the petitioner, or his authorized representative, shall
submit plans for and secure final plan approval, including the
change of use, within one (1) year from the effective date of the
change of zone; (B) the development shall include the required
parking and shall be provided within no more than one (1) access
point off Kilauea Avenue; (C) the requirements of the State Depart-
ment of Health and Department of Public Works shall be complied
with; and (D) all other rules, regulations and requirements shall
be complied with. Should any of the foregoing conditions not be
met the rezoning of the subject property to its original or more
appropriate zoning designation may be initiated by the Planning
Director."
SECTION 2. in the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its approval.
