AN ORDINANCE AMENDING SECTION 7.29 THE CITY OF HILO ZONE MAP,
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
SINGLE FAMILY RESIDENTIAL (RS-10) TO GENERAL COMMERCIAL (CG-20)
AT WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY

BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is hereby further
amended by adding thereto the following subsection:
"7.29 (uuu). The district classification of the
following area situated at Waiakea, South Hilo, Hawaii,
shall be General Commercial (CG-20):
Beginning at the Northeast corner of this parcel of land,
being also the Southeast corner of Executive Order 2230
to Board of Supervisors, County of Hawaii and on the south-
westerly side of Kinoole Street, the coordinates of said
point of beginning referred to Government Survey Triangu-
lation Station "HALM" being 664.59 feet South and 4822.02
feet East, thence running by azimuths measured clockwise
from true South:
1. 328° 47' 184.39 feet along the southwesterly
side of Kinoole Street;
2. 69° 26' 49.49 feet along the remainder of
Royal Patent 7601, Land
Commission Award 2327
to Barenaba;
3. 53° 00' 38.75 feet along same;
4. 60° 55' 42.52 feet along Lot 17-I, Land
Court Application 385;
5. 58° 47' 107.35 feet along Grant 12,352;
6. 148° 47' 180.00 feet along same;
7. 238° 47' 170.83 feet along Grant 12,352 and
Executive Order 2230 to
Board of Supervisors,
County of Hawaii;
8. 240° 55' 66.23 feet along Executive Order
2230 to Board of Super-
visors, County of Hawaii
to the point of beginning
and containing an area of
42,713 square feet.
"All as outlined in red on the map attached hereto,
marked Exhibit 'A' and by reference made a part hereof."
"This ordinance shall take effect forthwith upon the conditions
that (A) the petitioner, or his authorized representative, shall
submit plans for and secure final plan approval, including the
change of use, within one (1) year from the effective date of the
change of zone; (B) the development shall include the required
parking and shall be provided within no more than one (1) access
point off Kinoole Street; (C) the requirements of the State
Department of Health and Department of Public Works shall be
complied with; and (D) all other applicable rules, regulations
and requirements shall be complied with. Should any of the
foregoing conditions not be met, the rezoning of the subject
property to its original or more appropriate zoning designation
may be initiated.
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
