Nom. a BILL NO. 566 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO._... 53® AN ORDINANCE AMENDING SECTION 7.02 TiiE NORTii KONA ZONE MAP, ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, BY CHANGING TiiE DISTRICT CLASSIFICATION FROM OPEN (O) TO GENERAL INDUSTRIAL (MG-la) AT KALAOA 1ST-4TH, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-3-43:4. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02, Article 2, Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.02 (uu). The district classification of the following area situated at Kalaoa 1st-4th, "dorth Kona, Hawaii, shall be General Industrial (MG-la): Beginning at a pipe in concrete at the north corner of this parcel of land and on the highwater mark at seashore, the coordinates of said point of beginning referred to Government Survey Triangulation Station "AKAHIPUU" being 7953.54 feet South and 30,845.57 feet West, thence running by azimuths measured clockwise from True South: 1. 339° 23' 46.5" 745.31 feet along Keahole Airport; 2. 31° 18' 46.5" 520.0'1 feet along Keahole Airport to a pipe in concrete a highwater mark at seashore; 3. 144° 25' 46.5" 549.58 feet along the remainder of Keahole Point Lighthouse Reservation to a pipe in concrete; 4. 205° 14' 46.5" 768.34 feet along the remainder of Keahole Point Lighthouse Reservation to the point of beginning and containing an an area of 7.734 acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." "This ordinance shall take effect forthwith upon the condition that all conditions as outlined in Change of Zone Ordinance No. 424 be complied with. Should the stated conditions not be met, rezoning of the area to its original or more appropriate zoning designation may be initiated." SECTION 2. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 3. This ordinance shall take effect upon its approval.
