BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7,29 (aaaa).The district classification of the following area situated at Waiakea, South Hilo, Hawaii, shall be General Commercial (CG-7.5): Beginning at the South corner of this parcel of land and at the northeast corner of the intersection of Hoku and Mauna Kea Streets the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALM" being 400.54 feet South and 4,871.85 feet East and running by azimuths measured clockwise from true South: 1. 168° 20' 150.00 feet along easterly side of Mauna Kea Street; 2. 240° 55' 100.00 feet along Lot 7 of Block B of Villa Franca Lots; 3. 348° 20' 150.00 feet along Lots 6 and 3 of Block B of Villa Franca Lots; 4 60° 55' 100.00 feet along northerly side of Hoku . Street to the point of beginning and containing an area of 14,313 square feet. "All as outlined in r ed on the map attached hereto, ma rked Exhibit 'A' and by reference made a part hereof." "T his ordinance shall take effect forthwith upon the conditions that (A) the petitioners, or their authorized representative, shall submit plans for the proposed facility and secure final plan approval within one (1) year from the effective date of the change of zone; (B) construction of the proposed facility commence within one (1) year from the date of receipt of :Final plan approval and be completed within two (2) years thereafter; (C) the driveway access(es) to the subject property shall meet with the approval of the Department of Public Works; (D) a 30-foot intersection turning radius shall be dedicated to the County prior to the receipt of final plan approval; (E) the pavement width of Hoku Street and Mauna Kea Street to Kinoole Street shall be widened to twenty (20) feet from the driveway access points; (F) a 10-foot wide strip along Hoku Street and Mauna Kea Street shall be delineated and set aside for future road widening purposes; (G) the requirements of the State Department of Health and the Department of Public Works, relative to sewage disposal, shall be complied with; and (H) all other applicable rules, regulations and requirements shall be complied with. Should any of the foregoing conditions not be met the rezoning of the subject property to its original or more appropriate zoning designation may be initiated," SECTION 2. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 3. This ordinance shall take effect upon its approval.
