AN ORDINANCE AMENDING SECTION 7.04, THE KAILUA URBAN ZONE MAP,
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM MULTIPLE
FAMILY RESIDENTIAL (RM-1.25) AND DOUBLE FAMILY RESIDENTIAL (RD-3.75)
TO MULTIPLE FAMILY RESIDENTIAL (RM-2) AT HIENALOLI 5TH & 6TH,
NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-23:64, 65, 66 & 67.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.04, Article 2, Chapter 8 (Zoning Code)
of the Hawaii County Code, as amended, is hereby further amended
by adding thereto the following subsections:
"7. 04 (q-1). The district classification of the follow-
ing area situated at Hienaloli 5th, North Kona, Hawaii, shall
be Multiple Family Residential (RM-2):
Beginning at the west corner of this parcel of land and on
the northeast side of Hualalai Road (Kailua to Holualoa),
the coordinates of said point of beginning referred to
Government Survey Triangulation Station "NORTH MERIDIAN"
being 2,078.04 feet South and 2,125.51 feet East, and
running by azimuths measured clockwise from True South:
1. 260° 52' 390.28 feet along R. P. 1930, No. 1
to Asa Thurston, L. C. Award
387, Part 4, Section 2 to
American Board of Commissioners
for Foreign Missions;
2. 350° 52' 99.80 feet along Lot 377;
3. 268° 20' 56.00 feet, along Lot 377;
4. 342° O1' 11.86 feet. along Lot 377;
5. 72° O1' 30.67 feet along the northerly side of
Hualalai Road (Kailua to Holualoa);
6. 88° 20' 369.67 feet along Government Land;
7. 134° 30' 38.74 feet along the northeasterly side
of Hualalai Road (Kailua to Holualoa);
8. 138° 44' 52.29 feet along the northeasterly side
of Hualalai Road (Kailua to
Holualoa) to the point of beginning
and containing an area of 36,162
square feet.
"7.04 (q-2). The district classification of the follow-
ing area situated at Hienaloli 6th, North Kona, Hawaii, shall
be Multiple Family Residential (RM-2):
Beginning at the east corner of this parcel of land, on the
boundary between the lands of Hienaloli 5th and Hienaloli 6th,
and on the north side of Hualalai Road, the coordinates of
said point of beginning referred to Government Survey Triangu-
lation Station "NORTH MERIDIAN" being 2,132.77 feet South and
2,552.56 feet East, as shown on Government Survey Registered
Map 1676, and running by azimuths measured clockwise from
True South:
1. 72° O1' 123.92 feet along north side of Hualalai
Road;
2. 90° 00' 186.61 feet along north side of Hualalai
Road;
3. 102° 30' 35.48 feet along north side of Hualalai
Road;
4. 123° 00' 35.93 feet along north side of Hualalai
Road;
5. 134° 30' 0.36 feet along north side of Hualalai
Road;.
6. 268° 20' 369.67 feet along the land o f Hienaloli 5th,
L. C. Award 8524-B to Peke to the
point of beginning an d containing
an area of 9,230 squa re feet.
"All as ou tlined in r ed on the map attached hereto,
marke d Exhibit 'A' and by reference made a part hereof."
"This ordinance shall take effect forthwith upon the conditions
that (A) the plan approval process shall be complied with; (B) the
requirements of the Department of Water Supply, State Department of
Health, and the Department of Public Works shall be complied with;
(C) a future road widening setback lane be delineated along the
Hualalai Road right-of-way meeting with the approval of the Chief
Engineer. This setback line shall be included in the plans sub-
mitted for plan approval; and (D) all other applicable rules, regu-
lations and requirements shall be complied with. Should any of
the foregoing conditions not be met the rezoning of the property
to its original or more appropriate zoning designation may be

initiated by the Planning Director. Further sho ld
~ u any of the
foregoing conditions not be met the Planned Development Permit
(PDP) may be deemed null and void by the Planning Commission.
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its approval.
