HomeMy WebLinkAboutORD 1980-551 1976-1980BILL NO. 588 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. ~ i AN ORDINANCE AMENDING ARTICLI3 8, CHAPTER 6 (TRAFFIC CODE), OF THE HAWAII COUNTY CODE, AS AMENDED, RELATING TO SPEED REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to correct clerical and language errors contained in the speed regulations. SECTION 2. Article 8, Chapter 6, of the Hawaii County Code, as amended, is hereby further amended to read as follows: "ARTICLE 8. Speed Regulations SEC. 1. [MAXIMUM SPEED LIMIT] FIFTY-FIVE MILE PER HOUR MAXIMUM SPEED PERMITTED No person shall drive a vehicle upon [a] any highway at a speed greater than [55] fifty-five miles per hour unless otherwise specified by this [Code] Chapter. SEC. 2. [BASIC SPEED LAW] REASONABLE SPEED REQUIRED Subject to the limitations set forth in [Sec. 1 hereof] this Chapter, no person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent under the conditions then existing. SEC. 3. SPEED LAW VIOLATIONS p„ The speed of any vehicle upon a highway not in excess of the limits specified in Sections 1, 4 and 5 [hereof] of this Article or established as authorized in this [code] Chapter is lawful unless clearly proved to be in violation of [the basic speed law.] Section 2 of this Article. B. The speed of any vehicle upon a highway in excess of the [prima facie] maximum speed limits in Sections 1, 4 and 5 [hereof] of this Article or established as authorized in this [code] Chapter is [prima facie] unlawful.[unless the defendant establishes by competent evidence that the speed in excess of said limits did not constitute a violation of the basic speed law at the time, place and under the conditions then existing.] SEC. 4. [PRIMA FACIE] MAXIMUM SPEED LIMITS The following [prima facie] maximum speed limits shall be in effect except where a special speed limit has been enacted[.]: A. TWENTY-FIVE MILES PER. HOUR 1. When passing a school site or the grounds thereof, which are contiguous to, or located in close proximity to, the highway and posted with a standard 'school' warning sign while children are going to be leaving [.such] the school during opening or closing hours. [Such prima facie] This speed limit shall also apply during school recesses when passing any school grounds which area not separated from the highway by a fence or other physical barrier capable of restraining a child, while the grounds within seventy-five feet of the highway are 2. in use by [children] a child and the highway is posted with a standard 'school' warning sign. 2. During school days for a distance of up to [1,000] one thousand feet on both sides of a crosswalk designated by the Chief Engineer as a school crossing and posted with a standard 'school crossing' sign. 3. In a residential district except for the streets in South Hilo [as] described in Schedule 4[.] of this Chapter. B. THIRTY MILES PER HOUR [In a business district.] 1. In a business district. [C. THIRTY-FIVE MILES PER HOUR] [D.] C. FIFTY-FIVE MILES PER HOUR [On all highways unless otherwise specified by this code.] 1. On all highways unless otherwise specified by this Chapter. SEC. 5. SPECIAL SPEED LIMITS [The following prima facie] Special maximum speed limits [as] described in Schedule 5[, attached hereto and made a part hereof,] of this Chapter shall be effective when appropriate signs giving notice thereof are erected. SEC. 6. MINIMUM SPEED REGULATION A. No person shall drive a motor vehicle on a highway at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law. 3. B. When a speed limit is set at [(40)] forty or more miles per hour, the. driver of a vehicle proceeding on such highway shall not operate his vehicle at a speed less than [(15)] fifteen miles per hour below the posted speed limit whenever practicable except when necessary for safe operation. C. No person shall drive a motor vehicle on a highway at a speed lower than the required minimum speed, if to do so would impede other vehicular traffic[, and such person]. The driver shall pull to the side of the highway wherever safe to do so and stop if necessary to allow other vehicles to pass [such] the slow-moving vehicle. SECTION 3. Schedule 4 of Section 4, Article 8, Chapter 6, of the Hawaii County Code, as amended, is hereby further amended to read as follows: SCHEDULE 4 - [PRIMA FACIE] MAXIMUM SPEED LIMITS ARTICLE 8, Sec. 4 THIRTY-FIVE MILES PER HOUR 1. Pohakea Road, :from a point 7.4 miles mauka of the Old Mamalahoa Highway to the terminus of the paved portion, all trucks over 1 ton. TWENTY MILES PER HOUR 1. Anderton Camp Road in Papaikou, from the Mamalahoa Highway for a distance of 1,700 feet in the mauka direction. TWENTY-FIVE PQILES PER HOUR 1. All streets within the area bounded by Kamehameha Avenue, Ponahawai Street, Kinoole Street and Wailuku Drive. 2. All streets within the Lanakila Homes area, except. for Kapiolani Street. 3. Pakalana Street in Honokaa from a point 400 feet mauka of Kukui Street to Mamane Street. 4. Palani Road from a point 1,000 feet mauka of the Kailua-Kawaihae Road southwesterly to Alii Drive. 5. 5. Alii Drive from Kailua Wharf to the Kailua-Keauhou Middle Road (in the vicinity of the Kona Hilton Hotel). 6. Wiliwili Street from Kaumana Drive to Uluwai Street. 7. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable.
