BE IT ORDAINED BY THE COUNCIL OF 7.'HE COUNTY OF HAWAII: SECTION 1. Section 7.09, Article 2, Chapter 8 (Zoning Code) of the Hawaii County Code, as amer:ded, is hereby further amended by adding thereto the following subsection: "7.09( n ). The district classification of the following area situated at Puukapu, South Kohala, Hawaii, shall be Village Commercial (CV-20): Beginning at the East corner of this parcel of land on the Northerly side of Mamalahoa Highway, being also the South corner of Grant 9834 to Kahoohanohano the coordinates of which referred to Government Survey Triangulation Station "WEST BASE" being 318.52 feet South and 1,875.62 feet East and running by azimuths measured clockwise from True South: 1. 70° 21' 268.35 feet along the Northerly side of Mamalahoa Highway; 2. 149° 07' 305.00 feet along remainder of Grant 4736 to Hee Akou; 3. 257° 28' 20" 277.12 feet along remainder of Grant 4736 to Hee Akou; 4. 328° 56' 57.70 feet along Grant 4834 to Kahoohanohano; 5. 329° 07' 212.31 feet along Grant 4834 to Kahoohanohano to the point of beginning and containing an area of 75,660 Square Feet or 1.737 Acres. All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof. This subsection shall take effect upon the conditions that (A) prior to making any renovations to the existing commercial buildings or to the construction of any new commercial buildings, the petitioner or his autho- rized representative shall submit plans for plan approval to the Planning Department. Such plans shall meet with the recommended guidelines as presented in the draft Waimea Village Design Plan or if said plan is adopted by the County Council prior to the submittal of plans for plan approval by the Planning Department, then the designing principles of the adopted plan shall prevail; and (B) all other applicable rules, regulations, and requirements shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original or more appropriate zoning designation may be initiated." SECTION 2. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 3. This ordinance shall take effect upon its approval.
