HomeMy WebLinkAboutORD 1980-567 1976-1980BILL NO. 602 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. ~ 3~ AN ORDINANCE AMENDING SECTION 7.03(THE SOUTH KONA ZONE MAP) ARTICLE 2, CHAPTER 6 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10) TO NEIGHBORHOOD COMMERCIAL (CN-7.5) AT KEALAKEKUA, SOUTH KONA, HAWAII, COVERED BY TAX MAP KEY 8-2-02:PORTION OF 7. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.03, Article 2, Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.03 (aa). The district classification of the following area situated at Kealakekua, South Kona, Hawaii, shall be Neighborhood Commercial (CN-7.5): Beginning at the Southernmost corner of this parcel of land, being also a point on the Easterly boundary of Lot 36-D-2, the coordinates of said point of beginning referred to Govern- ment Survey Triangulation Station "PUU OHAU" being 8,717.26 feet South and 15,113.50 feet East and running by azimuths measured clockwise from True South: 1. 121° 43' 30" 63.93 feet along the remainder of Lot 36-D-2 and Royal Patents 3607 and 7533, Land Commission Award 8452 to A. Keohokaloli to a point; 2. 211° 43' 30" 60.00 feet along the remainder of Lot 36-D-2 and Royal Patents 3607 and 7533, Land Commission Award 8452 to A. Keohokaloli to a point; 3. 301° 43' 30" 80.28 feet along Lot 36-C and along the remainder of Royal Patents 3607 and 7533, Land Commission Award 6452 to A. Keohokaloli to a point; 4. 46° 27' 30" 48.35 feet along stonewall and along Grant 867 to Preston Cummings to a point; 5. 48° 45' 13.85 feet along stonewall and along Grant 867 to Preston Cummings to the point of beginning and con- taining an area of 4,340 Square Feet. All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof. This subsection shall take effect upon the conditions that (A) the area under consideration shall be consolidated with the adjacent 15,001 square foot lot identified as Lot 36-C within one (1) year from the effective date of the change of zone; (B) no structures shall be constructed on the subject area unless improvements are made to the existing grade; and (C) all other applicable rules, regulations and requirements shall be complied with. Should any of the fore- going conditions not be met, rezoning of the area to its original or more appropriate zoning designation may be initiated." SECTION 2. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 3. This ordinance shall take effect upon its approval.
