ORDINANCE NO. S J8
AN ORDINANCE AMENDING SECTION 7.09, THE KAMUELA ZONE MAP, ARTICLE 2,
CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, BY
CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-Sa) TO
VILLAGE COMMERCIAL (CV-20) AT PUUKAPU, SOUTH KOHALA, HAWAII, COVERED
BY TAX MAP KEY 6-4-01:101.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.09, Article 2, Chapter 8 (Zoning Code)
of the Hawaii County Code, as amended, is hereby further amended
by adding thereto the following subsection:
"7.09( o ). The district classification of the follow-
ing area situated at Puukapu, South Kohala, Hawaii, shall be
Village Commercial (CV-20):
Beginning at the South corner of this parcel of land on the
Northerly side of Mamalahoa Highway, being also the East
corner of Grant 4736 to Hee Akou, the coordinates of which
referred to Government Survey Triangulation Station "WEST
BASE" being 318.52 feet South and 1,875.62 feet East and
running by azimuths measured clockwise from True South:
1. 149° 07' 212.31 feet along Grant 4736 to
Hee Akou;
2. 239° 07' 98.08 feet along remainder of
Grant 4834 to Kahoohanohano;
3. 329° 07' 231.79 feet along remainder of
Grant 4834 to Kahoohanohano;
4. 70° 21' 100.00 feet along the Northerly
side of Mamalahoa Highway
to the point of beginning
and containing an area of
0.50 acre."
All as outlined in red on the map attached hereto, marked
Exhibit "A" and by reference made a part hereof.
This subsection shall take effect upon the
conditions that (A) the petitioner or his authorized repre-
sentative shall submit plans for the proposed commercial
building and secure final plan approval within one (1) year
from the effective date of approval of the change of zone;
(B) construction commence within one (1) year from the
effective date of receipt of final plan approval and be
completed within two (2) years thereafter; (C) in designing
the proposed development, the recommended guidelines in the
draft Waimea Village Design Plan shall be complied with;
and (D) all other applicable rules, regulations, and require-
meats shall be complied with. Shrn~tA a.,., ,.F ~L_ r__

or more appropriate zoning designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its approval.

the district classification from Agricultural (A-Sa) to Village
Commercial (CV-20) at Puukapu, S. Kohala.
