S7ti AN ORDINANCE AMENDING SECTION 7.09 (THE KAMUELA ZONE MAP), ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, RELATING TO THE DISTRICT CLASSIFICATION FROM AGRICUL- TURAL (A-5a) TO NEIGHBORHOOD COMMERCIAL (CN-7.5) AT PUUKAPU, SOUTH KOHALA, HAWAII, COVERED BY TAX MAP KEY 6-4-O1:PORTION OF 88. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.09, Article 2, Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is hereby further amended to read as follows: "7.09 ~(j)~ (k). The district classification of the following area situated at Puukapu, South Kohala, Hawaii, shall be Neighborhood Commercial (CN-7.5): Beginning at a pipe (found) at the South parcel of land on the Northerly side of being also the East corner of Grant 4210 Lyons, the coordinates of which referred Survey Triangulation Station "WEST BASE" South and 1,132.14 feet East and running measured clockwise from true South: corner of this damalahoa Highway, to Elizabeth W. to Government being 583.99 feet by azimuths 1. 149° 07' 436.00 feet along Grant 4210 to Elizabeth W. Lyons; 2. 260° 27' S0" ~414.37J 424.51 feet along remainder of Grant 4870 to John Crowley; 3. 329° 07' 150.00 feet along Grant 4736 to Hee Akou to a pipe (found); 4. 70° 10' 30" 204.93 feet along Lots 1 and 2 of Land Court Application 1696 to a pipe (found); 5. 330° 32' 208.40 feet along Lot 2 of Land Court Application 1696 to a pipe (found); 6. 70° 21' X182.50] 192.80 feet along the Northerly sic~e~Mamalahoa Highway to the point of beginning and contain- ing an area of ~2.540J 2.632 acres. ]"JAll as outlined in red on the map attached hereto, marked Exhibit ~'J"A"~'J and by reference made a part hereof./"./ This [ordinance] subsection shall take effect forthwith upon the conditions that (A) the petitioner or his authorized representative shall submit a subdivision plan and secure tentative approval within one (1) year from the effective date of approval of the change of zone. The petitioner/ represenative shall also be responsible for securing final subdivision approval; (B) construction of commercial structures shall commence on two (2) of the proposed lots within one (1) year of receipt of final subdivision approval. Construction shall be completed within two (2) years thereafter; (C) all other applicable rules, regula- tions, and requirements, including the "Plan Approval" process shall be complied with. Should any of the fore- going conditions not be met, rezoning of the area to its original or more appropriate zoning designation may be initiated." SECTION 2. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 3. in the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
